It also shows how the current legal aid system is leaving people like our clinic client in a position where they can be wrongly refused asylum and left without representation on appeal, with no real hope of being able to represent themselves in appeal proceedings.

This young person, with the support of their amazing foster carer and the skill and dedication of their legal aid lawyer, has just been recognised as a refugee and granted five years' leave to remain. Now all their hard work since arriving in the UK can come to fruition, and they can really shine!

and wrote a detailed referral to a brilliant local legal aid lawyer who, by a huge stroke of luck, had capacity to take them on (extremely unusual!). We then wrote them an application to send to the Legal Aid Agency to overturn the previous solicitor's decision to refuse them legal aid

When we met, together with their foster carer, they had an appeal hearing listed in just a couple of weeks and no legal representative. The clinic can't actually represent people, but we advised on obtaining an adjournment (and how to approach the hearing if that was refused)

Having arrived in the UK as an unaccompanied child, they were extremely poorly represented by a solicitor, who did no real work on their case and then dropped them as a client as soon as the Home Office refused their asylum application.

Judicial review work has also fallen from almost 500 grants of Civil Representation in 2018-19 to 156 in 2024-25 - in a period where need is certainly increasing rather than reducing. The only growth area has been Court of Protection work. www.researchgate.net/publication/...

One interviewee calculated that he & his paralegal would need to do 10 billable hours of work each in every working day, to meet billing targets on Legal Help work, yet also having to do average 2 hrs/day of unchargeable work to meet the bureaucratic requirements of the Legal Aid Agency.

New research on community care legal aid published today! Comm care remains in scope of legal aid, but provision has crashed: from 8,539 Legal Help cases started in 2009-10 to 1,636 in 2024-25. Providers described Legal Help work as financially unviable on fees that have not increased since 1996.

⚖️ Legal Aid funding for mental health work is not sustainable. When someone is severely mentally ill, they may need to be sectioned, and when this happens, they have a right to legal representation which is funded through legal aid.Over the last decade a solicitor's fee for taking on such a case as declined by 45% in real terms, and unsurprisingly there has been a decline in the number of solicitors who are willing to work in this area. In 2024/25 there were just 151 solicitors accredited as members of the Law Society Mental Health Scheme. Taking away an individual's liberty, not because they have committed a crime, but because they are mentally unwell is one of the most serious interventions the state can make over a person. This is an area of law that cannot safely be starved of funding.I put these challenges to the Lord Chancellor David Lammy earlier on this week, and I will be writing to him asking for a meeting so he is equipped with the information to understand why this needs his urgent attention.
