Given the many proposals on a greater UNHCR role in refugee staus determination/assessment in third countries. Evidence is clear that UNHCR can be locked into RSD without clear perspective of national takeover. Plus: such role can impede its political weight in the supervisory role of refugee law.

Amid all the positive elements of the UK Supreme Court judgment, it is also demonstrating how narrow the current law governing these proposals really is. Everything is analysed through the chain-refoulement paradigm, with emphasis on the procedure.

Full text of today's supreme court judgement. The Court assessed the quality of Rwandan asylum procedure so as to gauge the risk of refoulement by Rwanda (UK would have jurusdiction through chain refoulement). Bottom line: it's not good enough.
