One might ask if this is not a violation of 18 U.S. Code § 1343 - Fraud by wire, radio, or television. One might also ask, if this was done by an AI agent, as some have speculated, who bears criminal liability?
Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, transmits or causes to be transmitted by means of wire, radio, or television communication in interstate or foreign commerce, any writings, signs, signals, pictures, or sounds for the purpose of executing such scheme or artifice, shall be fined under this title or imprisoned not more than 20 years, or both.

As a Texan, the Blaze Foley and Guy Clark story referenced in this piece are particularly galling, though my personal experience was with a fake Uncle Tupelo song. I’m glad someone is not just exposing these scams but uncovering how they function.

Because the Bank Secrecy Act so incentivizes reporting of suspicious activity and currency transactions, FinCEN is sitting on a mountain of data that could be mined for this type of predictive policing. Recent computing advances presumably make it even easier to pick targets.

Recently I've heard from people who said a woman I wrote about more than 10 years ago ripped them off. Back then she was one of many people the Texas AG sued to stop them from defrauding immigrants. The agency's records show those cases are no longer a priority www.texasobserver.org/notario-frau...

The Supreme Court couldn’t be bothered to correct litigants who think filing a lawsuit gives them permission to commandeer the Fourth Estate and force journalists to burn sources. Fewer whistleblowers will be willing to come forward as a result.

Historically, the limited number of cases that have been brought against a journalist documenting a protest on private property have been handled as trespass cases at the state level. Those charges are almost always dropped, or if the cases go to trial, the journalists typically prevail.”
