One of these exceptions accords with principle and the other doesn't. One does not need to compensate a dead person for loss of earnings (and the 1976 Act deals with dependents). But if the point of exemplary damages is punitive why on earth aren't we punishing tortfeasors who cause death?

These debates are fasinating, but IMO the notion the courts would find any Act incompatible with Article 14 is tenuous. An irony is that the more these high level debates provoke debate in Parliament, the less likely the courts will be to interfere. You just have to read Lord Reed at the end of SC

This provision of the Assisted Dying Bill places a very low threshold on the criminality of medical professionals doesn’t it? Breaching the act negligently but in good faith carries a criminal penalty of 14 years?!
