Protesters amassed in Gosport, Hampshire, after rumours spread that the migrants might be brought ashore by lifeboats there. Police closed off access roads to the marina as activists rallied by Thomas on YouTube arrived to attempt to block the boat’s arrival. Crowds of masked protesters confronted a line of police to chants of “let them drown” sung by a child over a megaphone.

Is it an abuse of rights to rely upon the Convention to protect the funding of a political party who seeks to leave the convention and repeal the HRA? An interesting question!

Obviously the Code of Practice doesn't apply to employers, but the Code is itself clear this is very likely to be unlawful in the context of service provision
The service provider should consider whether there is a suitable alternative service for the trans person to use. In the case of services which are necessary for everybody, such as toilets, it is very unlikely to be proportionate to put a trans person in a position where there is no service that they are allowed to use.

The guidance gets the law wrong, and if service providers uncritically follow it, they may be acting unlawfully. Worse than that – they will be causing immense harm, and helping to strip trans people of their rights.”

This is just one example of something I worked on when I was at TSA ( did the messaging for this). Was aimed explicitly at Labour conf attendees. GLP has drawn on TSA's expertise and vice versa, at the very least through me but also more widely. Not the same orgs, but we do try to co-operate!

This thread is incorrect because the Bill covers belief as to one's sexual orientation, not just one's "legal" sexual orientation per the EA. So any abusive practice attempted to change one's belief as to their sexuality is covered – ie convincing a trans woman they are not attracted to women.
(2) “Conversion practice” means (subject to subsection (3)) any conduct carried out by a person towards an individual with the intention of—

(a) causing the individual—
(i) to have or not to have,
(ii) to believe that they have or do not have,
a sexual orientation or a particular sexual orientation; or

And the bits that worries me most is 9(b). I think there are lots of "therapists" who might try and fall under this exception. Such "therapists" are on of the key ways in which trans youth experience conversion in practice. So this could be a very large hole allowing kids to still be abused.
(9) In subsection (3) “health care services” means—

(a) all forms of health care services provided for individuals, whether relating to physical or mental health, and
(b) procedures that are similar to forms of medical or surgical care but are not provided in connection with a medical condition.

Now, the very bad bit. The exception for healthcare is very wide. It means that when conversion practices are institutionalised in the way they are in trans youth healthcare, doctors can just say "well all the other doctors do conversion practices too". Given what we know about NHS care...
(b) is carried out in the course of providing health care services to the individual concerned,
is not a conversion practice unless the person acts in a way that falls far below the standards reasonably expected of a person in their position.

A concern. I understand why this is mirrored for neatness of construction (and because the sexuality provisions have to be mirrored to protect asexual people. But I imagine we will see police complaints and attempted private prosecutions of trans supportive people by gender critical campaigners.

Let's start with the good parts. It's trans inclusive, and in a comprehensive way. It goes beyond the definition of gender reassignment in the Equality Act 2010, very explicitly including people with non-binary gender identities. This is great to see.
(8) The circumstances in which an individual has a transgender identity include (but are not limited to) where—

(a) the individual is undergoing, is proposing to undergo or has undergone a process of gender reassignment,
(b) the individual is transsexual,
(c) the individual identifies as neither male nor female or as not solely male or female.

This can occur, for example, where the complainant is discriminated against because of caring responsibilities for a person with a protected characteristic, such as disability (as happened in Coleman v Attridge Law [2008] ICR 1128; EBR Attridge LLP v Coleman [2010] ICR 242) or where the complainant is treated detrimentally because it is thought that she or he has a particular protected characteristic even if they do not (English v Thomas Sanderson Blinds Ltd [2009] ICR 543, paras 37 to 40 per Sedley LJ, where the protected characteristic was sexual orientation). What is required is that the protected characteristic is a ground for the treatment in question. Terms such as "associative discrimination" and "discrimination by perception" are not a critical part of the analysis. What matters in the former is whether the treatment of the complainant was done because of the protected characteristic of the other person. In a case of perceived discrimination, the correct comparator is someone who is not perceived to have that protected characteristic: Chief Constable of Norfolk Constabulary v Coffey [2020] ICR 145. In Coffey the EAT (Judge David Richardson) held that where a claimant is treated less favourably on the basis of a mistaken perception that she was disabled, the correct hypothetical comparator was a person who was not perceived to be disabled and who had the same abilities as the claimant. On appeal, Underhill LJ (who gave a judgment with which the other members agreed) upheld the decision and expressly endorsed this comparator (see para 68 referring to…
