The Drawing the Line coalition recommends that AI produced images that do not depict real victims should not be referred to as CSAM: drawingthelineprinciples.org. Following this advice would avoid the need to use the phrase “‘actual’ CSAM”.

It’s not legal, it’s just not CSAM, becsuse that’s a crime that requires a real victim. If it resembles CSAM it is still likely to be judged obscene, which makes it still illegal in just about every imaginable circumstance other than private possession in the home.

That would likely also be unconstitutional, though. The amicus brief that I co-authored for the Anderegg case (linked here) explains that all of the reasoning behind possession in the home being protected also applies, and probably more so, to production in the home. c4osl.org/cosl-files-a...

Or we could have (and we do) safeguards to ensure that these systems (search engines or AI) don’t expose sensitive personal information in actual use. Leaping instead straight to “governments should prohibit these systems outright” is hardly a right-neutral act and could cause much of its own harm.

Privacy seems to be just a convenient legal framework for Amnesty to use to express broader social concerns about generative AI (market power, labour displacement, environmental cost, etc). If an authors rights group issued this report they would use copyright instead. Neither seems that compelling.

Honestly it is a little embarrassing for Amnesty to put its name to this. It moved awfully quickly from the proposition that privacy rights can apply to information in public spaces to the conclusion that machine learning systems drawing on such information are inherently a mass privacy violation.

Books don’t need to be submitted for classification, however you do make an excellent point. Before a prosecution is commenced, the police should be required to have the content classified which would also give the author a right to be heard. I made a similar point here.

Good to know, but this leaves my question unanswered. If Thorn really has changed since its days working with Palantir and no longer supports compulsory AI scanning, it should say so. Bring a human rights advocate on board, such as the IWF used to have as its Chair. The child safety field needs it.
