This case extends beyond our three clients and their families. If the court rules against us, immigrants detained across Texas, Louisiana, and Mississippi will have a much harder time getting a judge to review whether their imprisonment is justified.

In July, a panel of the Fifth Circuit Court of Appeals sided with our clients, ruling that immigrants have the right to challenge their detention & must be afforded a bond hearing within 90 days of their detention. Then the full court backtracked. It vacated the ruling, agreeing to rehear the case.

ICE’s detention system is at a record size. Now ICE is making thousands of people even harder to find. Hiding the location of people with final deportation orders makes it more difficult for lawyers and families to reach them, and for people to challenge their detention and removal in court.

This shooting is the latest in what has become a pattern of increasing violence in immigration enforcement actions. Congress has given ICE and CBP a record amount of money with no oversight and few checks on abuse. It's inevitable that people will get hurt or even killed.

Alligator Alcatraz closed in June 2026, but these conditions are common in detention facilities across the country. The OIG also reported on the lack of health and safety standards at Torrance County Detention Facility in New Mexico, and the Stewart Detention Center in Lumpkin, Georgia.

One of the most shocking findings: Detainees were held in literal cages for hours as a form of punishment. The cages were roughly the size of a phone booth with a locking mechanism. The OIG stated that it had never seen this type of restraint.

Inhumane conditions exposed in DHS' own Office of Inspector General's report on "Alligator Alcatraz." Detainees were limited to showering only 3 times a week, lacked access to clean drinking water, and experienced overcrowding. ICE evaded responsibility, claiming it was the state of Florida.

Even getting your work visa petition APPROVED doesn’t necessarily mean you’re getting an employment-based green card anytime soon. At the end of FY2025, 642,000+ workers with approved employment-based petitions were still waiting for a visa number. Some will wait years. (5/7)

There’s another worrying shift: denials are rising. At one point in FY2025, USCIS was denying roughly 1 in 6 employment-based immigrant petitions. For EB-1A and EB-2 NIW petitions (categories for highly skilled workers) denial rates nearly doubled during that year. (4/7)
