"What is a legal observer?
Legal observers are trained to monitor, document and film the policing of  protests to ensure that gardaí are operating within the law.

Legal observers are independent and do not take part in the protest. They focus on the rights of those involved, rather than the issue that is being protested.

They’re also recognised human rights defenders by the United Nations, meaning there is an obligation to permit legal observers to fulfil their role unhindered under international law."Image featuring text:

Anyone who is interested in becoming a legal observer, attends one of our trainings, and upholds the terms of participation joins the Irish Network of Legal Observers.

The training takes place in-person and is about three hours long. Participants learn about the role, their responsibilities and the relevant criminal law concerning the right to protest and public order.

The law essentially allows State officials to control what questions they will, or will not, answer in UK-led investigations. Investigators will not be able to obtain, test and pursue evidence to establish the facts of the State’s actions, decisions or failures in relation to deaths or incidents.

Its provisions fail to ensure that the State will meet its Article 2 ECHR obligations by ensuring that its cooperation with these investigations is independent, effective, subject to adequate public scrutiny, and adequately involves the next-of-kin of victims and survivors.

It is also notable that despite claims by the government that these changes bring us in line with Europe, many European countries have a five-year residence requirement for citizenship. Citizenship supports integration, belonging and participation. These proposals, if implemented, do the opposite.

The Justice Minister's criminal legal aid changes are undermining access to justice and people's fundamental rights. They will especially impact people in vulnerable situations - such as people struggling with homelessness or addiction. We call on the Minister to reverse this policy immediately.
