NEW: DHS's Inspector General releases a scathing report about the Everglades detention camp known as "Alligator Alcatraz." The OIG finds that the now-closed camp, violated multiple ICE standards. The OIG also confirms detainees were punished with placement in a metal cage in the Florida heat.🧵

Underneath is a picture of a metal cage that is 4 feet 3 inches wide by 4 feet 3 inches long, and 7 feet 9 inches high. The cage itself is placed on a tiny spot of fake turf, and then surrounded by another chainlink fence with razor wire on top. The cage is covered by a roof, but it's entirely exposed to the outside otherwise, meaning mosquitos and no air conditioning.

Onto Comey's vindictive and selective prosecution argument. This ¶ is super important, bc it gets to how inapt exist precedents on whether related investigators can be source of animus. A president is different.

To determine whether another person’s animus can be imputed to a prosecutor, the Court
must analyze the specific facts of the case. The President’s course of conduct against Mr.
Comey makes the case for imputation clear—and the government does not attempt to explain
why the facts of this case do not support imputation. Instead, it cites cases (ECF No. 138 at 20-
22) in which courts rejected efforts to impute the animus of investigators, local prosecutors, or
other individuals with “no control over federal prosecutors” to the prosecutors who secured the indictments. United States v. Dickerson, 975 F.2d 1245, 1251 (7th Cir. 1992) (declining to
impute alleged animus of FBI agents and state police officers); see United States v. Spears, 159
F.3d 1081, 1087 (7th Cir. 1998) (declining to impute alleged animus of a state prosecutor and
investigators from the Bureau of Alcohol, Tobacco, and Firearms); United States v. Gilbert, 266
F.3d 1180, 1187 (9th Cir. 2001) (declining to impute alleged animus of IRS investigators);
United States v. Cooper, 617 F. App’x 249, 251 (4th Cir. 2015) (per curiam) (declining to impute
alleged animus of local law enforcement). Those cases are readily distinguishable from this one,
where the animus springs from the head of the Executive Branch who has supervisory authority
over all federal prosecutors and who exercised that power in this case.

A lawyer on the ground on Sunday morning saw just how close things were, and how the flights were only stopped because a federal judge moved at light speed to halt the Trump admin's illegal operation. She saw the plane begin to taxi to take off, only to turn around at the last second and come back.

14. I arrived at the FBO Sun Valley Airport in Harlingen. I could see two of the ICE transport planes parked on the tarmac. The stairs had already been pulled away and the door to the plane, which I had been informed had the children on board, was already closed. I went to the building at the tarmac. I could see officers inside. I knocked on the door. I told the young man who answered the door that I was an attorney, that I had clients on the plane, and that I had a court order stopping the plane from leaving. I asked to speak to his supervisor. I gave the same message to every person who badged in the locked door. I told them they were all complicit in violating a federal court order if the plane left. The young man came back out and told me that he had advised his supervisor who was trying to contact ICE. I explained again the federal court order and the importance of stopping the plane. Another agent came out and physically pulled the young man back into the building. I could see the other staff members through the glass. They were jeering and laughing. I repeated that they were all complicit in the violation of the judge’s order. 15. Around 10:30 am, while I was standing outside the FBO airport building, I saw one of the planes begin to move. I identified it as the plane that I believed ProBAR’s clients to be on. I knocked on the door again. I watched the plane taxi away from the building. About 20 minutes later, the plane taxied back and parked again. I stayed watching the plane with the children on it. It was hot, sunny, in the upper 90s. I thought about the children on that plane and how hot and stuffy it must have been, how tired they must be, and how scared and confused.
