They think they can avoid the shame by implicating as many others as possible in their shamefulness—that there will be no one *left* to shame them, because everyone will be either complicit or dead. This is a fantasy, and they will fail.

To an extent it’s right to say that these people have no shame (I’ve said it myself). But in some ways it’s more that they have an overpowering fear of shame—the abyssal shame they know they deserve to feel. The performative cruelty is whistling in the dark.

Second, the whole point of the lynching spectacle was to indict and implicate the white community involved the lynching. It tied them together; it implicated them; it bound them to each other in guilt and shame.

But yesterday’s decision combined this bloodthirstiness with another Roberts Court trend: disdain for lower courts. Here, the 6th Circuit had issued a stay to give itself time to assess a challenging, novel procedural issue. The Supreme Court threw their work in the trash without explaining why.

Presiding over botched, rushed executions has been something of a Roberts Court specialty. Last year, e.g., they allowed Alabama to asphyxiate Anthony Boyd with nitrogen gas, rejecting Boyd’s request for an alternative method of execution. Boyd visibly suffered for more than 30 mins before he died.

the state botched the execution attempt, trying to kill Christa Pike for two hours before she was taken to the hospital. This happens more often than you might think; in fact, Tennessee had botched the previous execution it attempted to carry out back in May.

The best I can come up with is the idea that the law doesn’t require teachers to instruct students on the 10 Commandments or otherwise engage with them. Which, it’s true, is a factual difference. But wouldn’t a poster advocating LGBTQ+ inclusion impose a very similar “burden” on the Mahmoud parents?

What is the best argument for why a Ten Commandments law like the Arkansas one does *not* run afoul of Mahmoud’s reading of the Free Exercise Clause? (I think it obviously does, but I’m curious how this plays out in a world where the Establishment Clause is all but a dead letter)
