2- They believe that after the midterms, there will be a push to regulate based on actual dangers, and they are trying to create a third party (akin to the ESRB for videogames) so that they can claim they are mitigating harm, to avoid suffering any real consequences or government response.

Is it possible to measure cognitive aptitude? Maybe. Have IQ tests proven to be an accurate measurement in any meaningful capacity? Not even a little. They suffer from cultural biases, academic biases, racial biases, and are generally only a measure of how well a subject can predict the assessor.
