Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026This is now a 50 year tit-for-tat on this despite a favourable SCC ruling (which doesn't absolutely abolish essential service provisions so there will be litigation on this no doubt). And the economic consequences of this for workers is clear with the levels of inequality we have reached. 010
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026Thanks for this. Certainly don't oppose the other stuff in there but this is why I and other labour scholars stress the historical context to this stuff. Labour law had to catch up to strikes not the other way around Chip away at the right to strike and you weaken labour overall. 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026And when we get out of this emergency? There's not even a sundown provision on this as far as I can tell (I could be wrong). So you can't even frame it as a temporary sacrifice. 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026I definitely will, thanks for the heads up Markham, love your interviews! 010
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026In the video Max talks about business making sacrifices of its own. Fair enough. But so far they have received the Productivity Mega Deduction which isn’t a sacrifice but an incentive. What incentives are workers receiving? (fin) 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026The right to strike and free & fair collective bargaining have been under attack since the 1970s, recent Supreme Court rulings notwithstanding (but that didn’t stop Section 107). Why labour should accept sacrifices now to its rights makes zero sense. Canada survived strikes in both World Wars (5/n) 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026So I think the national emergency narrative doesn’t stand up to historical scrutiny. Especially since the 1970s back-to-work legislation and reopening of public sector contracts by governments have always been in the name of solving some kind of “emergency” - inflation, deficits, etc. (4/n) 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026The pressure from war time strikes was a big factor in the government issuing the PC 1003 which is still the framework for industrial relations in Canada. There was also a strike wave towards the end of WW1 from 1917 into the early 20s, but many of those strikes got put down forcefully. (3/n) 100
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026Max talks about emergencies and sacrifices given the moment, yet most Canadian unions refused to make a no-strike pledge during WW2! Most American unions did though. Ironically this led to a strange de facto alliance between the American state, big business… and the Communist Party USA. (2/n) 200
Gerard Di Trolio @gerardditrolio.bsky.social · 23/09/2026Disappointed how @maxfawcett.bsky.social framed federal labour law changes in this video. 1. Charter rulings are clear about limiting the strikes. 2. Max talks like strikes can just spontaneously be called - that is not how the system works. Plenty of advance notice is given (1/n) #canlab #cdnpoli 110
