Today, the Government has approved a new EHRC Code of Practice. This document tells service providers that they can exclude trans people from single-sex spaces. This is unlikely to mean that trans people will be excluded routinely, but it does mean it may happen more often.

This document tells service providers that they can exclude trans people from single-sex spaces. 
This is unlikely to mean that trans people will be excluded routinely, especially from basic services like toilets, but it does mean it may happen more often.
In response to requests from trans young people and trans adults, we’ve co-developed guidance on what the new Code of Practice means, how to assess your safety in public spaces, and what to do when challenged.
Here’s what you need to know:
The Code of Practice applies to organisations, not individuals.
There is not going to be a ‘toilet police’, and it is not a crime to use spaces and facilities that align with your gender. 
It may be more likely that services will challenge trans people or ask trans people not to use single-sex spaces.
It means that we will not always know if an organisation or venue is going to be trans inclusive.
Ultimately, what this means is that you will need to assess and check your safety as you move through the world. This is not new - we have always needed to assess our safety in toilets, changing rooms and in spaces with strangers.
Remember:
•	If you do not feel safe, leave. Your safety is more important than making a point. 
•	Avoid conflict. You are under no obligation to respond to someone who tries to stop you from using a basic service.
•	Document your experience. The law is not settled in this area, so if you are excluded, record your experience
•	It is not illegal to use facilities like toilets in line with your gender, and you should not face any police action

We see, and we hear the response to the draft conversion practice Bill. We know there are loopholes that need to be closed, and we welcome the insight and critique. GI is a trans community, and we would never support a bill that puts trans people at risk or allows conversion practices to continue.

Conversion practices have caused lasting harm to too many LGBTQ+ people. We're proud to have led the campaign to ban conversion practices, working tirelessly over the past six years to get to this stage.We're living through turbulent times for LGBTQ+ rights, and many trans people are feeling worried and uncertain about the future. 
There is still a long way to go before everyone in the LGBTQ+ community is living free from discrimination. The publication of this draft Bill to ban conversion practices is a positive step forward, and a reminder that progress is possible.

👏 We did it! Today the Government have published their long overdue draft Bill to ban conversion practices. For far too long, LGBTQ+ people have been subject to practices that seek to change or suppress who they are. Conversion practices have caused profound and lasting harm to many LGBTQ+ people.

No matter how hard it seems or how long the journey is, we’ll always be here in love and solidarity with the whole trans community.
What GI is doing:
We’ll publish revised guidance for services and public functions on how to keep including trans people while minimising risk
We’ll create guidance for our communities on staying safe and keeping connected
We’re demanding that the government step in to sort out the mess they’ve created.
It will be a long journey, but we will keep pushing for change until we have fair and equal treatment of trans people in all areas of life.
Remember:
There is no toilet police
There is no realistic way to blanket exclude trans people – even if the government really wanted to. 
You are under no obligation to answer questions about your gender or sex. If someone harasses or humiliates you to try to make you prove it, this is discrimination
There is no reason not to keep doing the things you love and building the life you want
One thing is more important than anything else: Keep living your life.

EHRC Updated Code of Practice: GI’s response

The EHRC has finalised its Code of Practice which advises services and businesses on how to interpret the Equality Act. 
It doesn’t change the Equality Act, but it influences how courts interpret it.
We’ve taken the time to digest it and have released our full response on what the changes mean for services and trans people...The Good
•	Recognition of non-binary people
•	Recognition of trans children
•	Gendered groups can include trans women
•	No ID checks for toilets and basic services
...The bad
The Code empowers those who want to exclude trans people from services and spaces and makes life harder for those who want to support trans people. 
Domestic violence refuges that have been supporting trans women without issue now feel they have to jump through hoops to keep supporting them legally. 
Businesses and workplaces are likely to go gender-neutral – sometimes at considerable cost – to avoid lawsuits. 
The Code treats trans people as a third sex and sets a...The Ugly
Exclusionary changes have a chilling effect on trans people’s participation in public life. 
Creating an atmosphere of fear around basic access needs leads people to self-isolate.
We are already seeing members of our community disengage from sport and physical activity, from education, and even from basic healthcare because of the overwhelming fear of exclusion...

The amended EHRC Code of Practice has been released. Lots of people will make claims about what is and isn’t going to happen as a result, and there will be many different interpretations of the Code in the next few days. We urge everyone not to jump to conclusions.
The amended EHRC Code of Practice has been released today.  
This is a document that interprets the Equality Act. It has been revised since last summer, following the judgement in For Women Scot v Scottish Government. 
We know that the first draft of the new Code of Practice was cruel, inhumane, and discriminatory towards trans people. 
We campaigned for that draft to be rejected and demanded that any new version should be one that fully considered and guaranteed the human rights of all trans...Trans people deserve the same treatment as everyone else, and a Code that cheapens or weakens our rights and protections makes a mockery of the Equality Act and the principles it was built on. 
The revised Code will now be laid before Parliament for 40 days, after which it is almost certain to become law. 
Lots of people will make claims about what is and isn’t going to happen as a result, and there will be many different interpretations of the Code in the next few days...

Today is International Day Against Homophobia, Biphobia and Transphobia.  This year’s theme is “At the heart of democracy”, a powerful reminder that truly democratic societies must have full, meaningful equity and justice for all.
IDAHOBIT

Across the world Governments are pushing through authoritarian policies and exclusionary legislation that targets trans people, including the EHRC’s Code of Practice here in the UK. 

But our communities and allies have the power to fight back through solidarity and collective action. And our communities have the power to nurture us and bring us joy.  

We’ve survived regressive laws and Governments before, and we’ll do it again if we must.

You're right, we don't know what changed and we know that the revised code may still be harmful (and we are hopeful less so). But we want to celebrate the wins when we can, and acknolwedge the hard work that made this happen.

When the draft Code was first sent to the Government, we expected it to be accepted without issue (as is standard practice). The fact they have had to amend it and recognise they got their legal analysis wrong is a big win - it is only through tireless campaigning over months that this has happened.

We did it! The EHRC have amended their guidance on sex after the Government sent back their inhumane first draft. We don't know what the new guidance will look like, and there may still be parts that exclude trans people. But we do know that our voices made a difference at a critical moment.
