Disney’s $10M YouTube Fine is a Massive Warning for Brands and Creators
The FTC's settlement with Disney, which involves a $10 million penalty for violating children’s privacy laws, signifies a shift in accountability for content providers. Disney's mislabeling of child-directed videos on YouTube led to unauthorized data collection. The settlement mandates stricter compliance measures and emphasizes the creator's role in protecting minors online.

I think a point of continuing confusion on the issue will surround what the USCO notes as “works of authorship that are perceptible in AI-generated outputs.” But no doubt there is more to unpack on this point.

So now... TikTok and ByteDance are racing to the Supreme Court! Otherwise, their last hope is some sort of action from President-elect Trump and/or the next Congress.

❌ TikTok and ByteDance have time to seek some sort of emergency relief from the Supreme Court, if the high court is even willing to get involved. The Appeals Court noted this as the whole reason it agreed to expedite hearing this appeal in the first place.

❌ The Act contains an option for the President (and only the President) to offer an extension on the deadline if certain terms are met for qualified divestiture. The court isn't willing to be the first in history to override an Act of Congress, despite First Amendment challenges brought by TikTok.

Here's what they wrote: ❌ Congress and the President passed an act that very deliberately laid out a timeline for TikTok/ByteDance, so why should the judicial branch override that timeline?

It's (more) officially over for TikTok at the Appeals Court level 💀 On Friday, the court put a final nail in the coffin and the platform's last hope for emergency relief now rests the U.S. Supreme Court. The Appeals Court gave reasons it isn't granting a temporary pause on the ban or forced sale.

With a Trump return to the White House looming, things are looking uncertain for the social media giant and this Act even being enforced. Does a new administration mean a total TikTok blackout for American users? Or will nothing change??

The court found that Congress acted reasonably in determining that ByteDance’s ownership of TikTok posed a national security risk because it could allow the Chinese government to collect intelligence on American users and manipulate the content they see.
