Being outside the ICC’s jurisdiction does not stop it from charging someone. Israel did not agree to be subject to its jurisdiction either, yet Netanyahu has an arrest warrant. And the ICC does have jurisdiction if he or any charged American travels to any of the 125 countries that recognize it.

Rubio says the US is sanctioning the ICC to stop it from prosecuting service members, border patrol, and elected officials. The ICC has never even charged an American or hinted it will pursue the Trump admin. It's an admission that he knows DHS and DOD are committing international crimes.
