A #KpopDemonHunters parody channel is getting terminated due to multiple #copyright strikes from Netflix. These videos are highly transformative and parody is generally fair use, so these copyright claims are absurd.

I'm not a fan of AI art, but I worry that some of the recent AI copyright cases will chill human-made transformative expression (a.k.a. fan works).

"Transformative use" isn't all there is to #fairuse - it also matters whether a use is commercial or not. In the famous Betamax case, the court said that NC use of a copyrighted work is presumptively fair, so the burden is on the copyright holder to show that a NC use is likely to harm the market.

IQ bell curve meme with the captions "fan works are fair use" (over the cartoon person on the left), "actually fan works can only be fair use if they include criticism or commentary" (over the person on the center), and "fan works are fair use" again (over the person on the right). The three cartoon people are positioned over the left, center, and right sides of a bell curve labeled "IQ score".

Excerpt from the Sony Corp. of America v. Universal City Studios (1984) court opinion: "Thus, although every commercial use of copyrighted material is presumptively an unfair exploitation of the monopoly privilege that belongs to the owner of the copyright, noncommercial uses are a different matter. A challenge to a noncommercial use of a copyrighted work requires proof either that the particular use is harmful or that, if it should become widespread, it would adversely affect the potential market for the copyrighted work. Actual present harm need not be shown; such a requirement would leave the copyright holder with no defense against predictable damage. Nor is it necessary to show with certainty that future harm will result. What is necessary is a showing by a preponderance of the evidence that some meaningful likelihood of future harm exists. If the intended use is for commercial gain, that likelihood may be presumed. But if it is for a noncommercial purpose, the likelihood must be demonstrated."

tl;dr: the average American likely produces 5000-8000 copyrighted works every year - including social media posts, text messages, photos/videos, etc. 😂

The beginning of a conversation with ChatGPT using the following prompt: "How many copyrighted works (e.g. social media posts, photos/videos, emails, writings) does the average American create every year? Probably a lot [laughing emoticon]"
