ICE continues to cause damage in our communities and instill fear of being shot, detained, or separated from their loved ones simply because they encounter immigration enforcement officers.

After being hospitalized for his injuries, the 28-year-old man who ICE shot in Marble Hill near the Bronx yesterday has been taken into ICE custody and transferred to a detention facility outside New York State. We must also not forget a 5-yr-old was inside the vehicle when the shooting happened.

A transfer to another state does not necessarily mean the bond cannot be paid. If ICE has issued a bond order, keep the paperwork and try to complete the payment process.  Questions? Email us: info@envisionfreedom.org

If ICE granted your loved one a $7,500 bond before transferring them out of New Jersey, you may still be able to pay that bond online through CeBONDS.

We secured the release of 73 people from ICE detention in September—thanks to your support. They are now returning, or beginning the process of returning, to their families and communities. At least 40 of the people we bonded out had bonds set at $7,500 by ICE officers.

His bond was set at $50,000. Envision covered half, while his friends and family came together to cover the remaining $25,000. He was detained at Buffalo Federal Detention Facility in Batavia, New York.

Wow! After we put out our call last week, we got donations from you! We paid 20 bonds in total last week, and 11 of those were $7,500 bonds set by ICE officers. BUT, 21 more PEOPLE are still waiting in detention right now because they can't pay these bonds.

We saw the impact immediately. Envision Freedom Fund has paid bonds for more than 30 people set at $7,500 by ICE agents, and many were detained in New Jersey. That $7,500 amount stands in stark contrast to the $30k–$50k bonds we had been seeing in recent months.

Instead, many are entitled to a bond hearing. The ruling applies throughout the Third Circuit, covering New Jersey, Pennsylvania, Delaware, and the U.S. Virgin Islands.

In Case You Missed It: Three weeks ago, the Third Circuit ruled that people who are already in the United States and detained in the interior cannot be automatically held without bond under the government’s interpretation of immigration law.

Note that in the past three weeks, many people detained at Delaney Hall in New Jersey have been released on $7,500 immigration bonds set by ICE officers, following a court case in the Third Circuit late last month.

ICE officers indeed have the authority to make the initial bond/custody determination and set a bond amount for people who they deem eligible for release on bond.

In New York City, the ICE bond office arbitrarily imposes a one-day delay before accepting payment for a bond and has sometimes turned away families attempting to post bond in person.

Some immigration judges regularly set unaffordably high bonds or deny bond without transparency. Others require people to find a “sponsor” before they can be released, even when the bond money is already secured.

And getting someone out of detention isn’t always as simple as having the money to pay their bond. Every week, we encounter barriers created by immigration authorities at nearly every stage of the bond process.

When the legal advocacy community ramped up habeas operations in federal district courts, we saw a swift and steady rise in bond requests, reaching nearly 100 requests in March. Now, we’ve reached a new sustained high point: more than 90 requests in three of the past five months.
