Adventures in Being K’s Dad. K is my son, an adult with autism & his dad’s best pal. My boy loves the beach most of all. It brings him peace & relaxation. And my wife has for years found opportunities to get him to one beach or another as often as she can. They’re beach buddies, & I love that.

Thirty-six years ago this afternoon, Beth and I exchanged vows at the Hotel Hershey. The road from there to here has included love, a much-adored son, laughter, respect and support through a few challenges. I'm a fortunate man indeed.

Visited the doctor this morning. After seeing him, I stopped at the front desk to make my next appointment, and the nice lady looked up at me and asked "Are you checking out?" This caused me some alarm as the doctor seemed to suggest I'm doing fine.

51 years ago today, Jimmy Hoffa disappeared from the parking lot of the Machus Red Fox restaurant in Bloomfield Hills, MI. When I was a young adult living in Toledo, I used to drive up that way to take my grandmother to lunch. She always chose the Red Fox. I always wondered what Grandma had in mind.

On this date in 1925, a jury in Dayton, TN, found schoolteacher John Scopes guilty of violating the Butler Act by teaching evolution. The judge fined Mr. Scopes $100. The Tennessee Supreme Court later vacated the fine on a technicality. Yay appellate courts. #AppellateSky

My great-grandparents on the Fine side of the family were Rachel and Reuben. I think of them as the sandwich generation.

As the Committee of Five memorably sings in "1776," John Adams was obnoxious and disliked. However, I think he got (at least) one thing right. On July 2, 1776, the Continental Congress voted to declare independence, and that's the day we should celebrate as Independence Day. 1/2

Two-hundred fifty years ago today the Committee of Five that drafted the Declaration of Independence transmitted its draft to the Continental Congress. I’ve no doubt the file was labeled “TJ FINAL, FINAL, REALLY FINAL,” and the transmittal message said something like … 1/2

My octogenarian Jewish mother in Toledo--who likes to follow legal news and then quiz me when I call her--is going to ask me tonight about today's SCOTUS decision in T. M. v. Univ. of Md. Medical Sys. Would I be a bad son if I just told her that Rooker Feldman is one of the guys at her synagogue?

I used to think that, in my next career, I'd open a restaurant on Capitol Hill called "Justice Burger" but, just to mess with people, I'd only serve frankfurters and salmon.

On the phone this evening with my octogenarian Jewish mother in Toledo and mentioned I have an oral argument in NYC tomorrow. I coughed. “Oh, dear,” Mom responded, “make sure to take cough drops with you.” This, my friends, is why she is my secret weapon.

Directors and editors often use an establishing shot at the beginning of a scene. A good introduction in a legal brief serves a similar function.

Adventures in Being K’s Dad. I’ve written about my son, an adult with autism and his dad’s best pal. My boy loves the swings, so I take him to the playground a lot, including this morning. Truth be told, his old man has a hectic week coming up, and this time is a morale boost. Thanks, Sonny Boy.

I love living in a place with so much history. One hundred sixty-one years today, President Lincoln’s funeral train arrived in Harrisburg for a day. This is the train at the old train station, which was a few blocks east of the current train station.

My boy and I have been watching old reruns of "Mutual of Omaha's Wild Kingdom" on Sunday mornings. If you're of a certain age, you know the show and the "cast." I watched it 50 years ago with my dad. As an old guy, I share this lesson with a hat tip to my wife: in a world of Marlins, be a Jim. 1/

I don’t know how you spent your Sunday, but my boy and I started the day visiting the final resting place of Nancy Kulp, Miss Jane Hathaway from “The Beverly Hillbillies.” Her grave is in the Westminster Presbyterian Cemetery in Mifflintown, Pennsylvania. If you’re of a certain age, you’ll get it.

Today's Pa. Supreme Court decision holding that the Commonwealth's Constitution bars the imposition of mandatory sentences of life without the possibility of parole is remarkable and historic. The case didn't decide retroactivity, and that will be the next huge issue. www.pacourts.us/assets/opini...

One of the things that sometimes happens when you've been practicing law since the ink on the Magna Carta was still wet is that you think about how the practice has changed since you started. I was thinking yesterday about how we get opinions. 1/

Is this the first time a SCOTUS opinion has alluded to Sir Laurence Olivier?

I had occasion recently to listen to the recording of an oral argument in which counsel persistently failed to stop talking when a judge interrupted with a question. I get the temptation to try to finish what might be a crucial point. 1/

You know that moment. You've been struggling to figure out how to write an argument on a particularly dense subject. You've started, stopped, revised and considered sticking a sharpened No. 2 pencil in your left eye in frustration. 1/

Then you see the argument, fully formed, in your mind's eye, and the race is on to get it on paper (or screen) while it remains clear in your thoughts. 2/

This is Market Square in Harrisburg, Pennsylvania. 165 years ago today, Abraham Lincoln stopped here to offer some remarks on his way to Washington for his first inauguration. My office is in the building in the background with the top floors clad in gray. I so love the history of this area.
