This seems like a very odd choice to me. I remember this issue distinctly and even at the time it wasn't really funny. It was heartfelt -- sad, angry, confused. The humor was extremely gentle because everyone was so bruised. I guess what I'm saying is: thanks but no thanks.

It would be an enormous step forward if the DC Circuit, and the courts more broadly, adopted this Groucho Marx test. There's no judicial obligation to fall for transparent legal bullshit that's obviously contradicted by the President's public statements on social media.
