#LegalEthics Tidbit: Can I omit material facts from my complaint if the boilerplate template I’m using didn’t have a space for them? A Indian citizen residing in Iowa filed a pro se complaint in IA federal court seeking to compel the ... (cont.) storage.courtlistener.com/recap/gov.us... #law
At the end of the complaint, the document again addressed the issue, and contained this statement:
It is my understanding an attorney wrote the template for the company, but I have had no communication with that attorney and that attorney did not modify, review, or participate in the drafting of my filings. Rather, like any template, I completed the blanks in the template with the information about my specific case. No attorney assisted me in the process of filling in the blanks in the template.

The proposed filings are clearly 2 not the work of an organic
mind with linguistic talents developed in the crucible of
human experience. It is obvious that the entity that drafted
them has an artificial intellect that is unconcerned with, for
instance, getting to the point. To comment on the filings at
length would only serve to reward them. Still, I offer some
particularly glaring artificial ticks that are a complete waste
of the reader's time. Throughout the motion, the author has
taken special care to tell the Court what it is NOT arguing or
suggesting. For instance:
“Defendant does not ask the Court to accept any of that ...,
and does not ask it to revisit ....”

The only other time I used a large language model for legal research was in December 2025 for the opposition briefs at issue. About that time an acquaintance who works in the AI industry was talking about the amazing capabilities of AI, and I responded with my story of being fed fake cases months prior. He told me that they are constantly making improvements, that ChatGPT has changed enormously in the ensuing months, and that ChatGPT fixed the fabrication problem. I bought into the hype. When I tried it again in December 2025 for these opposition briefs, I was on guard for nonexistent cases and wholly irrelevant cases. I looked up every case it fed me and confirmed it was a real case, in the proper jurisdiction, and I quickly reviewed each case to be sure it dealt with the relevant subject matter. It did not occur to me that the tool could or would invent quotes from these real cases or invert their holdings.

The AI victim then ended his remarks by conveying his love

assuming Your Honor denies you're a child predator; would
I be correct in making that assumption?
*12 SUPERIOR COURT JUDGE 4: Mr. Clark, make
your argument, please.
RESPONDENT: Well, my point is I don't believe it's up to
you to decide if you are a child predator. You -- I'm sure
even child predators, like all child predators, deny they're
child predators. So, you know, for you to decide whether
or not these are true certainly is a problem. I mean, they
basically are true, Your Honor. I mean that's one of the --
the defenses, you're scowling, but one of the defenses --
I mean, the 1st Amendment protects true statements. True
statements can never be contrary to the 1st Amendment and
these are true statements.
SUPERIOR COURT JUDGE 4: As an officer of this court,
are you saying I'm a child predator? You, not your client?
RESPONDENT: I'm saying that is a true statement.
SUPERIOR COURT JUDGE 4: Is that your argument?
RESPONDENT: It is a true statement that given the actions
of this Court you could correctly be described as a child
predator.
SUPERIOR COURT JUDGE 4: Are you describing me as
a child predator?
RESPONDENT: I think that is an accurate description.
SUPERIOR COURT JUDGE 4: Okay, thank you.
RESPONDENT: Again, looking at the fact that this Court
has separated [S.M.] from his children for two years
without any conceivable reason, the children are going
through torture. The family is going through torture. But,
again, you know, we say you're a child predator, you say
you aren't. Well, I -- I don't think that's a determination for
Your Honor to make.

This court believes that it is also important that litigants,
including pro se litigants, not be permitted to drive up the
cost of litigation (and the settlement value of a case) by using
AI to file a large number of overly long, repetitive, and/or
otherwise bad faith motions. Otherwise, a situation is likely
to develop whereby the “playbook” for pro se litigants calls
for them to use AI to greatly drive up the nuisance value of
claims and thereby ensure that defendants are motivated to
pay significant settlements for even patently meritless claims.
In so stating, this court notes that this case has not even left the
discovery stage, and even the most cursory look at the docket
makes it clear that plaintiff has driven up the cost of litigating
this case beyond any justification for a case of this nature.
This court believes that the expense which defendants have
been unjustly forced to incur in this regard is another factor
militating in favor of dismissal.
