Halfway across the country in St Cloud Minnesota
Group of protestors on a sidewalk. One holds a sign reading
"They're eating the CHECKS
They're eating the BALANCES"
Another walking past holds a sign captioned "How tariffs work" with a drawing of Trump peeing into a fan that's blowing it back in his face.
Across the street you can see more protestors, one with a sign reading "Protect Free Speech"

The Motion will be made on the grounds that Defendants are in violation of this Court's March 13, 2025, preliminary injunction, 11, 120, in two ways: (1) by failing to communicate to unlawfully terminated employees the information ordered by the Court, and (2) by placing employees whom the Court ordered to be immediately reinstated only on "administrative leave rather than returning them to active service. Pursuant to this Court's authority to enforce its own orders, Plaintiffs respectfully request that unless Defendants establish full compliance with the Court's preliminary injunction by the date of their opposition brief (which the Court ordered to be filed by noon on March 31, 2025), the Court should enter an order setting a date certain for compliance by Defendants and requiring daily status reports until compliance is achieved, and if any Defendants fail to conse into compliance by that date certain, to find those Defendants in contempt, and impose prospective, conditional-civil sanctions for each day thereafter that those Defendants remain out of compliance

UNITED STATES DISTRICT COURT

NORTHERN DISTRICT OF CALIFORNIA

AMERICAN FEDERATION OF GOVERNMENT EMPLOYEES, AFL-CIO, et al

Plaintiffs,

Na. C25-01780 WHA

ORDER RE SUBJECT-MATTER JURISDICTION

United States District Court Northern District of California

INTRODUCTION

UNITED STATES OFFICE OF PERSONNEL MANAGEMENT, et al

Defendants.

Early on, I followed three recent decisions in other district courts holding that claims brought by public-sector unions concerning federal employee terminations had to be channeled through the Merit Systema Protection Board and/or the Federal Labor Relations Authority and therefore the district court had no subject matter jurisdiction over those claima, although I accepted subject-matter jurisdiction over claims by the organizational plaintiffs After further briefing, however, this order bolds that the district court does have subject-matter jurisdiction over these claims by public-sector unions and that my carlier ruling to the contrary was mistaken.

ANALYSIS

"The district courts shall have original jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States 28 USC. 11331. "Not may have jurisdiction, but chall. Axon Enter. v. FTC, 598 US 175,205 (2023) (Gorsuch, J., concurring). Congress nonetheless may countermand jurisdiction by enacting other schemes for specific claims usually review by an agency and then by an appeals court. The result is that a district court shall hear a challenge to an agency action unless (1) Congress provided a statutory review scherme limiting Section 1331 and (2) the claims brought are of the type Congress intended to be reviewed within it.
