I hesitate to share the disinformation our opponents are putting out about Prop I, but it needs to be rebutted. They are spending a fortune in a bad faith attempt to block affordable housing and rent relief. The authors of the latest attack mailer know their claims are false.

Daniel Lurie is trying to do to the Mayor’s Office of Housing what Donald Trump is doing to the Department of Education. Lurie is smearing his own housing department, calling it a slush fund, and defunding it. His cynical approach threatens to undermine affordable housing in SF for years to come.

L.A.'s version of Prop I just allocated another $466m to affordable housing. This is what Lurie is opposing for San Francisco amidst an affordability crisis. Such contempt for low-income and working class San Franciscans.
Screenshot of LA Times
headline: LA approves $466 Million in Affordable Housing Spending
Caption: Los Angeles is set to go on an affordable housing spending spree. The City Council unanimously approved $466.6 million in funding that will be doled out to developers, nonprofits, land trusts and other organizations to build and renovate affordable housing.
The pool of money is the largest in the city housing department's history, topping last year's $387 million.
Roughly 70% of the record budget will come from Measure ULA, the so-called mansion tax, which levies a 4% or 5.5% tax on L.A. property sales above $5.4 million.
Accountability was top of mind during Tuesday's City Council meeting. The spending plan, which now awaits Mayor Karen Bass' approval, includes an amendment requiring the housing department to provide quarterly updates on where the money is going, as well as project timelines and any significant delays or challenges.

BREAKING: DC Circuit, on a 2-1 vote, rejects DOJ's request to immediately implement BOP's policy on medical care for trans prisoners that would seek to end such care. Wilkins (Obama) & Garcia (Biden) are in the majority; Walker (Trump) dissents. The anti-trans policy will remain blocked for now.
BEFORE: Wilkins, Walker, and Garcia, Circuit Judges
ORDER
Upon consideration of the motion for stay pending appeal filed in No. 26-5236, the opposition thereto, and the reply; and the letter filed September 3, 2026, which the court construes as a motion to stay the district court's August 26, 2026, order on appeal in No. 26-5310; it is
ORDERED that the motion for stay in No. 26-5236 be dismissed as moot. It is FURTHER ORDERED that the motion for stay in No. 26-5310 be denied.
Appellants have not satisfied the stringent requirements for a stay pending appeal. See Nken v. Holder, 556 U.S. 418, 434 (2009); D.C. Circuit Handbook of Practice and Internal Procedures 33 (2026).
Appellants have not shown a strong likelihood of success on the question of whether Program Statement 5260.01 is arbitrary and capricious because the Bureau of
*Circuit Judge Walker would grant the motion to stay in No. 26-5310 for the reasons in the attached dissenting statement.Prisons (BOP) did not adequately consider its own experience providing gender-affirming care under its prior policy. See Int'l Dark-Sky Ass'n, Inc. v. FCC, 106 F.4th 1206, 1213 (D.C. Cir. 2024) ("An action is arbitrary and capricious when the agency relies on inappropriate factors, fails to consider important aspects of the problem, or ignores relevant evidence."); Butte Cnty., Cal. v. Hogen, 613 F.3d 190, 194 (D.C. Cir.
2010) (explaining that "an agency's refusal to consider evidence bearing on the issue before it constitutes arbitrary agency action"). For example, BOP makes claims about the security impact of providing gender-affirming care without addressing whether such issues have occurred.
Moreover, appellants have not made a strong showing that the district court's order violates the PLRA or improperly grants class-wide relief. Additionally, appellants' argument that the district court's order is overbroad to the extent it affects the Program Statement's provisions regarding surgical procedures is likely forfeited because it was not raised first in the district court. See Gov't of Manitoba v. Bernhardt, 923 F.30 1/3, 179 (D.C. Cir. 2019) ("Absent exceptional circumstances, a party forfeits an argument by failing to press it in district court.").
Because appellants have not made a strong showing that they are likely to succeed on the merits, it is not necessary to address whether they have established irreparable harm or whether the remaining factors favor a stay.
The Clerk is directed to enter a briefing schedule.

I’ve learned that the $54m the mayor announced yesterday as new is in fact money that was already in the budget approved months ago. I’ve tried to give the benefit of the doubt, and welcomed his declaring a “rent emergency,” but it is not ok to mislead people like this.
Screenshot of Lurie’s social media statement:
“San Francisco is in a rent emergency, and we're taking action to help people stay in their homes.
Here is the legislation we're moving forward:
- When a property owner wants to raise the rent with banked rent increases and capital improvements they will be limited to 10% per year.
- When renters fall behind by less than one month of rent, they can't be evicted
- When a landlord takes a multi-unit property off the market, we are raising the amount they owe in relocation by 25%.
- For renters who are at risk of eviction, we are investing more than $54 million in emergency rental assistance, legal defense, and more.
We are also investing $3 million to expand Tenants Rights to Council and $1 million in a Know Your Rights Campaign.
We know there is more work to do, which is why we need to continue to build more homes so San Franciscans can afford to stay and build their futures here.
Thank you to our Board of Supervisors for supporting this work. We'll keep working every day to make San Francisco a place where people can put down roots and build their futures.”

There are two reasons for the opposition to Prop. I. First, conservatives want to give a tax break to billionaires selling $10+ million properties. Second, conservatives recognize the initial success of Prop I when funds were allocated as intended and want to prevent affordable housing at scale. 🧵
