Attorney General Schwalb Secures $1.7 Million in Connection with Misclassification of Construction Workers

DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 22h
Our settlement requires Welch to pay $1.7 million in penalties and worker restitution. It also requires Welch to overhaul its practices to comply with District law. The company will ensure all workers on its DC projects are correctly classified through payroll reports and subcontractor audits.

We sued Welch, general contractor Whiting-Turner, and three labor brokers in 2024. Our lawsuit alleged that the five companies avoided paying taxes into critical safety net programs and cheated hundreds of workers out of wages and benefits by misclassifying them as independent contractors.

WORKER WIN: Welch will pay $1.7 million for its role in a widespread, illegal worker misclassification scheme. Welch's construction projects included the City Ridge development in Ward 3. We are rooting out misclassification from DC and getting money back for the workers who earned it.

Traces of these Native American sites have been uncovered all across DC — from the hills of Van Ness and Chevy Chase to the riverbanks of the Potomac and the Anacostia. On Indigenous Peoples Day, we honor the Piscataway, the Nacotchtank (Anacostans), and all who first made the District their home.

Before the government buildings, federal monuments, expansive streetscapes, and residential neighborhoods of present-day DC, this land was lined with Native American villages, quarries, burial mounds, and hunting and fishing sites for thousands of years.

Ward 7 resident Sehree Mickel knew something was wrong when her Prime packages were arriving slower than her friends in other parts of DC. So she filed a complaint with our office. Her complaint launched an investigation that led to $7.25 million in refunds for her and thousands of her neighbors.

Attorney General Schwalb Secures $8.25 Million from Amazon for Secretly Excluding Ward 7 & 8 ZIP Codes from Prime Delivery Services
071
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
A big part of my job as Attorney General is to ensure companies operating in DC treat our residents fairly. At a time when so many in DC are struggling, I will not allow anyone to take advantage of our communities. No corporation, no matter how rich or powerful, is above the law — not even Amazon.
190
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
Amazon will pay $7.25 million in refunds to Ward 7 and Ward 8 residents who were excluded and $1 million in penalties. Critically, Amazon has lifted its delivery exclusions for ZIP codes 20019 and 20020. It will also be required to notify customers and DC if it makes similar changes in the future.
180
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
That's wrong, and it crossed a serious line. We sued Amazon in 2024 — alleging it violated District consumer protection laws. Today, we asked the Court to approve an $8.25 million settlement that provides refunds to impacted residents and implements safeguards to prevent this from happening again.
190
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
The company says that it made the change for safety purposes. But here is the problem: Amazon never told people in these ZIP codes they were being excluded. So for years, DC residents in ZIP codes 20019 and 20020 were deceived into paying full Prime rates while receiving inferior services.
190
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
Amazon knew this could slow down deliveries, but it covertly did it anyway. Then, delivery speeds in these ZIP codes plummeted. In 2021, over 72% of Prime packages in 20019 and 20020 were delivered within two days of check-out. By 2023, only 25% of Prime packages were delivered within two days.
160
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
Here is what happened. Amazon heavily promotes same-day, one-day, and two-day delivery speeds in its ads for Prime. But in 2022, Amazon secretly decided to stop using its trucks to make Prime deliveries in ZIP codes 20019-20 and only service these areas with third-party delivery like UPS and USPS.
170
DC Attorney General Brian Schwalb @dcattorneygeneral.bsky.social · 01/10/2026
NEW: Amazon will refund thousands of Prime members in Wards 7 and 8 for secretly excluding them from full delivery services. The exclusions have now been lifted, and Amazon will also be required to change its practices. No corporation is too big to be held accountable for deceiving DC residents.

Law enforcement has made multiple drug arrests and has responded to more than 190 calls for service at the property in 2026 alone. A pregnant tenant with three kids regularly witnesses individuals smoking crack cocaine outside her unit. The toxic fumes often seep into the family’s apartment.

Attorney General Schwalb Announces Subprime Auto Lender Will Pay $380,000 for Taking Advantage of DC Car Buyers

Usually, when a lender lends you money, it's because they think you will be able to pay it back. Not in this case. CAC made auto loans to people it knew couldn't afford them — then profited as they lost their cars and drowned in debt. It also let car dealers inflate loan costs with hidden add-ons.

These are the fourth and fifth settlements we secured in our lawsuit against RealPage and the 14 landlords that colluded to hike DC rents. We secured over $11.7 million so far and won changes to make DC's housing market fairer. We will not stop until all remaining defendants are held accountable.

Now, JBG Smith and MAA will pay a combined $9.3 million to the District for payments to impacted residents, penalties, and legal fees. They will also reform their policies to stop using anticompetitive software to set rents. And they will refrain from encouraging others to use such software.

We sued RealPage and 14 corporate landlords in 2023 for operating like a housing cartel. The landlords shared non-public rental data through RealPage's centralized price-setting algorithm to artificially hike rents on more than 50,000 apartments. The scheme worsened DC's affordability crisis.
