A revised (and better) version is now available! The paper now tackles the post-Cisco ATS landscape and discusses non-federal tort law more extensively. It also has a simpler title, "Rights Over Remedies." You can read it at the same link. 👇🏽 papers.ssrn.com/sol3/papers....

Rights Over Remedies
Why do victims of corporate human rights abuse sue corporations in tort when their chances of winning compensation are almost zero? I argue this is because they

Incredibly honored to see the paper as "Highly Recommended"! The piece reinterprets tort rights of action as a mechanism of epistemic resistance, particularly for marginalized victims of corporate abuse. Substantive update coming soon after the ATS is now gutted in Cisco v. Doe. Stay tuned!

Excited to share my job talk paper "Postcolonial Private Law" now on SSRN where I bring international law into conversation with private law theory in arguing for empowering Global South people as rightsholders in transnational supply chains. Thanks for the shout-out @lsolum.bsky.social!

1/2 Are there humans in human rights due diligence? Read my latest draft paper on SSRN: papers.ssrn.com/sol3/papers.... I argue there that HRDD laws entrench the marginalization of people whose human rights they ostensibly protect by focusing on stakeholder engagement clauses.
