The value in passing permitting reform is for the next 20 years, not the next 2. We obviously disagree on those costs, benefits and trade-offs, which is fine.

As for you original point on Trump: Trump is a lawless president; tough to really do much to change that during the remainder of his lame duck, and I don't pretend permitting reform does anything there. I think the way to solve that problem is to stop electing lawless presidents.

That is why AB2065 is so necessary. Even with clear laws to protect ratepayers in place, utilities will keep trying to dodge them if they know there isn't a price for illegality. I hope Gov. Newsom signs the bill, and that other states pursuing utility accountability follow suit!

Sempra's filing is even worse. They listed every employee in their filing w/ a title like "Manager," "Specialist," "Vice President," or "Attorney," conveying no info despite clear legal requirements. And they are charging ratepayers for 95%+ of nearly every employee they list.

An "Investor Relations Analyst Principal's" pay is 100% in rates. A "Sr. Director Investor Relations" is 78% in rates. Investor relations is prohibited from recovery. These are people making $200+/year, and there are many of them. That's millions or more in possible violations.

Some "Govt Relations Reps"' pay are booked 100% to rates. Some "Regulation Relations Advocacy" staff's pay are being 96 - 98% booked to rates. The law's definition of "political influence" is quite broad: it beggars belief that these job titles aren't conducting any of it.

PG&E's filing ignored clear instructions in the law for how to file this form (e.g. they didn't include job descriptions for these employees.) Even with those obfuscations, PG&E appears to be charging ratepayers for some employees' salaries that it shouldn't be.

AB 1167 required utilities to post information about the compensation they paid to the employees who work in departments that conduct activities that they're prohibited from recovering in rates (politics, advertising, investor relations, etc.)

Is all this necessary? A tour through CA utilities' filings this year shows that yes, it is! CA utilities began annual disclosures this spring in response to AB 1167. Those forms show massive red flags on compliance...

AB 2065 also takes away the California utilities' oft-used "oopsie" defense, where they claim they booked the costs to ratepayers accidentally. The bill specifies that they get amnesty if they catch their own mistakes, but if regulators or others do, they're on the hook.

AB 2065 specifies that if a utility tries to charge customers for prohibited costs and gets caught, they will be penalized for that same amount on top of issuing a refund. If the utility keeps screwing up, the penalty jumps to treble that amount. leginfo.legislature.ca.gov/faces/billTe...

AB 2065 closes a gap in last year's excellent AB 1167, which banned utilities from charging customers for political activities and other costs that don't benefit customers. 1167 mandated penalties for violations, but not amounts. energyandpolicy.org/california-l...

A great utility accountability bill is on Gov. Newsom's desk that I and probably many others didn't catch in the flurry of wildfire liability drama: AB 2065 would penalize investor-owned utilities who try to break the rules and charge ratepayers for illegal expenses. 🧵

I hadn't realized how much of this was already playing out in fights, like between Google/Amazon and Dominion in VA, over whether hyperscalers can displace utility capital (and ROE).

What I found most interesting was that when you dig into it, you realize that sure, the hyperscalers may take some pushing. But none of this is a deal-breaker for them, and they're leveraged. The biggest opposition will come from the monopoly utilities.

The framework I've laid out here is hardly new: "... Data centers 1) paying their fair share, 2) driving savings through flexibility, 3) displacing utility capital, all in exchange for a more reasonable interconnection process that keeps them on the grid."

I did SFO-NYC in June w a 1.5 and 4.5-yo, solo, and similarly felt world-conquering afterward. A red eye w kids is a whole other kettle of fish though. Impressive!

If you haven't made this switch yet and it's available to you: do you know how much more pleasant a school drop-off is by bike/e-bike than by car? My kids like it. No drop-off line. Get your blood moving just a little (or a lot, your call) to start the day... often my fave 15 min of the day.
