attorney in Petrova's federal habeas proceedings, which also concerned the events at issue in this
case. Doc. No. 45 at 13. The attorney had provided a sworn declaration attesting that, during his thirty-five-year career, he was not aware of any person having been prosecuted for smuggling without having been processed by customs officers for a "failure to declare" violation, nor could
he recall ever seeing smuggling charges brought for failing to declare a research sample

circumstances presented, the foregoing suffices to satisfy Petrova's burden of supplying "some

travelers who have willfully failed to declare research samples or similar items but were not
Harvard-affiliated visa holders were not treated the same way.

CBS News goes quite a bit further in revealing how involved Miller is in DOJ affairs: ~Miller pressured DOJ to take action against a political activist who protested outside of his home. ~Miller asked FBI counterterrorism agents to go undercover in his neighborhood’s political activist group.

What might have normally been a local law enforcement matter is now federalized and turned into a counterterrorism investigation. Miller's own interest in criminalizing threats and protests against his family shows how politicization and personalization have merged under Trump II.

But a glaring conflict of interest is just one element of this story, and probably not the most important one. This episode appears to be a subset of broader Trump admin push to lump all threats together with legitimate political opposition and brand them as domestic terrorism.

Judge Leibowitz was the first judge to ever rule on the constitutionality of the statute. As Politico’s Kyle Cheney notes, the statute that Judge Leibowitz invalidated underpins several Trump administration noncitizen-voting prosecutions that it ramped up ahead of the midterm elections.

In dismissing the prosecution of a Jamaican national for illegally voting in the 2020 election, U.S. District Judge David Leibowitz (a Biden appointee) found 18 U.S.C. § 611, which outlaws voting by noncitizens in federal elections, to be a “voter qualification statute.”

The pattern of retaliation is clear. But there’s a more recent wrinkle. Last week, the WSJ — which you can see has been all over the Pulte story for many months — reported that Pulte hadn’t just targeted Democrats’ mortgages. He’d also examined the mortgages of Todd Blanche!

The fallout from that episode was swift and severe, as the WSJ previously reported: Joe Allen, the FHFA acting IG, was asked to step down. Around the same time, the administration fired about a dozen officials within Fannie Mae’s ethics and internal investigations unit.

The budget cuts are just a continuation of a retaliation campaign by Pulte against internal watchdogs that’s been going on for a year. His mortgage fraud jihad resulted in an internal investigation over whether he improperly obtained mortgage records of high-profile Dems, including Letitia James.

The draconian cuts would eviscerate the IG’s office, it told Congress in a letter this week: “We will be forced to reduce staffing by approximately 70-80% in FY 2027, which will result in the discontinuance of essentially all criminal investigations conducted by our Office of Investigations.”
