Another day, another order holding that the mail voting EO is unlawful! ecf.dcd.uscourts.gov/cgi-bin/show.... I am so exceptionally proud to represent these clients. Now, this is ANOTHER court order the government would have to try to get vacated to implement their illegal scheme. Not on our watch.

Yesterday, the Supreme Court, in a shadow docket unsigned decision, greenlit Alabama's plan to gut representation for Black voters, despite a 3-court panel opinion finding the map intentionally discriminates against Black voters & Alabama will have to upend its electoral scheme to implement it.

The Louisiana Governor has cancelled an ongoing election so that he can dismantled the current districts and grab more power for his political party while silencing the voices of Black voters. This is not and cannot be how we run elections. If this is allowed, votes already cast will be thrown out.

President Trump isn’t sure how his executive order related to mail voting can be challenged. We have a few ideas. Starting with this: the President has no power over election rules. The Constitution gives those powers to states and Congress and no one else.

Remember that the EO purporting to limit birthright citizenship is just as unconstitutional today as it was yesterday. The constitution makes clear that babies born in the U.S. are American citizens. Period.

This is a truly outrageous development. For 60 years, voters have been able to vindicate their rights under the Voting Rights Act. Those individual actions have been transformational, creating the multiracial democracy we have today.

Arkansas Board of Apportionment, 86 F.4th 1204 (8th Cir. 2023), reh’g denied, 91 F.4th 967 (8th Cir. 2024), we held that § 2 of the Voting Rights Act (“the Act”) does not provide for an implied private right of action to remedy certain voting guarantees contained in the Act. The question before us today is whether private plaintiffs can instead maintain a private right of action for alleged violations of § 2 through 42 U.S.C. § 1983. We answer this question in the negative and vacate the judgment of the district court.

The North Carolina State Board of Elections has formally certified Democrat Allison Riggs as the winner of a state Supreme Court.  Riggs was sworn-in at a brief ceremony in Raleigh. "We won this election more than six months ago, but it was fewer than seven days ago that this race finally ended."

It should not have taken 6 months and endless litigation to get here. But the fact that a court ultimately stopped these shenanigans and ordered the results certified is so critical. Kudos to all the democracy advocates on the ground that never gave an inch here.

Breaking: A district court STOPS the President's unlawful order directing changes to federal election law. Specifically, the court enjoined an attempt by the President to direct an independent agency to require documentary proof of citizenship to register using the national form.

Big decision from the 9th Circuit here holding that Arizona's various restrictions on registration (including proof of citizenship) violate the NVRA & the Civil Rights Act. I was proud to argue this case on behalf of a big tent of excellent advocates and extraordinary clients. Here we go.

Judge Coughenour, an appointee of Ronald Reagan, said from the bench: "I’ve been on the bench for over four decades, I can’t remember another case where the question presented is as clear as this one is. This is a blatantly unconstitutional order[.]" Indeed.

Hi friends, new here but have an update. While most elections are over, there are still some *very* close ones. And, unsurprisingly, some candidates are up to some very anti-democratic antics in those races. Case in point: the Supreme Court of North Carolina race is within hundreds of votes.
