Excellent news for all Americans—the Supreme Court blocked the administration’s attempt to mess with mail voting! In a resounding victory, a majority of justifes said our clients were “likely to succeed on the merits” of our case against the USPS rule—which is auspicious for future elections too.

It was bad enough that the administration was trying to leverage the credibility of the Census Bureau to manufacture support for its false claims of voter fraud. Slapping the Bureau’s logo on the shoddy work of an activist group that is a well-known peddler of conspiracy theories is next level.

Pay attention to what Mullin did not provide: any evidence to back up his wild numbers or even an explanation as to where those numbers came from. They are almost certainly false or wildly overstated. This administration has a poor track record with false allegations of election improprieties.

Trump's speech was shockingly thin. It was well know that he would try to manufacture a false case that the 2020 election was stolen and that our elections are compromised, but he made up an extremely weak case that, even if true, wouldn't support those claims. And of course, none of it is true.

Most commentators puzzled by the unprincipled Roberts Court ruling in the AL redistricting case conclude that the only possible explanation is rank partisanship. There is another possibility. Maybe the majority is condoning and promoting race discrimination. The evidence supports either explanation.

The Court said it did not strike down the Voting Rights Act. It just made it that no one could ever use it. But the Voting Rights Act still exists in theory, just not in reality. The American people do not have to just swallow all of this. We can demand more from our courts. /5

States are free to racially discriminate in redistricting so long as they say they are doing so for partisan advantage. Courts are not allowed to find that race discrimination was the motive when discrimination also gives a partisan advantage. It almost always does (and has). Impunity. /4

Intentional race discrimination is illegal, but courts aren’t really allowed to find it. When a legislature intentionally discriminates, courts must presume they acted with good faith. See, the discrimination disappears when you presume it away! Impunity. /3

States are free to make last-minute changes that disrupt elections. Federal courts are not allowed to step in close to elections, even to stop last-minute illegal abuses. That would be too disruptive. Impunity. /2

2 cardinal principles of democracy: (1) It is wrong & illegal to suspend an ongoing election when voting is already underway. This causes immediate disenfranchisement and chaos. WaPo reports Louisiana’s governor will announce on Friday that he is suspending the House primaries where people have already started voting and redraw the map; I’d expect them to go for an all-Republican map and eliminate both majority-Black districts, not just one.

Black voter participation soared right after the VRA passed in 1965. But not until 1992, after Congress strengthened the VRA to require majority-minority districts, did we start getting closer to proportional Black representation in Congress. Because Black votes finally counted more in the South.
Black representation in the US House, Confederacy vs. rest of the US: chart showing a brief surge during Reconstruction, then almost none during Jim Crow, then a big surge after the VRA (mostly in the rest of the US, not the Confederacy), then a big surge all over the US, especially the Confederacy. Only in the last 10 years has Black representation in the House grown to about the same proportion as the US black population.

In today's disastrous opinion in Callais, SCOTUS essentially rewarded the despicable "Southern Strategy" with a free pass to engage in race discrimination so long as the perpetrators call it partisan gerrymandering. Read this excerpt from page 27:
Second, a full-blown two-party system has emerged in the
States where §2 suits are most common. Gingles arose in 
the context of a one-party system in which black and white 
voters had starkly different voting patterns despite their af-
filiation within the same party. 478 U. S., at 59. In the 
area involved in Gingles, an overwhelming majority of 
white voters did not vote for any black candidate in the
Democratic party primary elections, which for all practical 
purposes selected the candidates who would ultimately ob-
tain office. Ibid. And in general elections, white voters in 
heavily Democratic areas often ranked black candidates 
last among Democrats. Ibid. Such intra-party disparities
showed that black voters had less opportunity to elect their
preferred candidate because of their race, not because of
their partisan affiliation. 
When the vast majority of voters, regardless of race, fa-
vors the same political party, a map that is disadvanta-
geous for members of one racial group cannot be explained 
on the ground that it was drawn to favor a particular polit-
ical party. But in a State where both parties have substan-
tial support and where race is often correlated with party
preference, a litigant can easily exploit §2 for partisan pur-
poses by “repackag[ing] a partisan-gerrymandering claim
as a racial-gerrymandering claim.” Alexander, 602 U. S., at
