Why do we have free speech at all? John Marshall wrote that the 1st Amendment only protected speech from federal action. The 14th Amendment’s framers extended it against states (the incorporation doctrine). SCOTUS only recognized it in 1925 in Gitlow v New York—a case of a revolutionary socialist.
