A more charitable reading toward Scalia (and imho a worse indictment of Alito) is that he recognizes we need more justices who subscribe to an actual constitutional philosophy, instead of judicial activists who just make up doctrine to get to the results they want.

This is partially why it drives me crazy that a jury conviction in a federal case doesn't immediately result in incarceration (when jail is effectively mandatory). Sure let's wait a few months for probation report and then let's wait till you are ready to surrender...🙄
