ICYMI, amicus briefs piled into the D.C. Circuit this week discussing whether Judge Boasberg should be allowed to *start investigating* the federal government's March 2025 contempt of court. This inherent sanctioning authority is indispensable because it allows courts to address situations where attorneys or parties have potentially deceived the court. After all, fraud on the court is more than garden-variety fraud: it is “a wrong against the institutions set up to protect and safeguard the public,” Hazel-Atlas Glass Co. v. Hartford-Empire Co., 322 U.S. 238, 246 (1944), and is “directed to the judicial machinery itself,” Baltia Air Lines, Inc. v. Transaction Mgmt., Inc., 98 F.3d 640, 642 (D.C. Cir. 1996) (quoting Bulloch v. United States, 721 F.2d 713, 718 (10th Cir. 1983)). Thus, conduct that corrupts the truth-seeking process and frustrates a court’s ability to adjudicate impartially is not merely an injury to an opposing litigant, but an affront to the judicial institution itself. Chambers, 501 U.S. at 44.
