The DOJ's first argument - which SCOTUS agreed with - was that the rule hasn't been published. Now that it has, the DOJ argument is that the court doesn't have jurisdiction because the plaintiffs need to go through the Postal Regulatory Commission - which takes 90 days, putting it past the election.
