The work of justice is to plant trees under whose shade you may never sit; and the fight against organized oligarchy, against the immense power of concentrated money, is often a battle for a sunrise you may never see. But one day, someone, somewhere, will sit under a tree, watching the sun rise.

AGs: don’t let oligarchs distract you from a simple reality: the people stand with you. Your fight is theirs: for the workers whose jobs this will eliminate, for the communities losing money, for the stories and representation we will lose, for the free press, and for democracy. #BlockTheMerger

But again, neither providing for citizenship for the children of immigrants upon the parents' naturalization, nor giving citizenship to children of citizens born abroad, would be needed to be granted by statute if the common law or constitutional rule was jus sanguinis.

Brendan Benedict @brendanbenedict.bsky.social · 02/07/2026
His other point about naturalization of children following naturalization of parents covers an obvious category not covered by birthright citizenship -- children who were born abroad and immigrated here, who could become citizens when their parents did instead of waiting for the age of majority.

Have you read his amicus brief in Barbara? It has a similarly strange focus on the early naturalization laws. In the @evanbernick.bsky.social @jedshug.bsky.social amicus brief, we pointed out that they don't support his claim about the common law -- actually they support the opposite inference.

There weren't "gangs" of "Gypsies" in the U.S. The point was that Congress considered a historic analogue to the categories of "unlawful entrant" and "temporary sojourner" and concluded their children would be citizens under the 14th amendment.

Brendan Benedict @brendanbenedict.bsky.social · 08/04/2026
Senators used the historic example of the Roma people and asked if their children would be citizens if born in the U.S. There were English statutes against their entry, and they were "transient". Lash says we claimed they were here instead of in Europe, missing the point.

There were many failed opportunities to do something real or pass a war powers resolution. Now's not the time for litigating the past. But Congress can't do anything from home. So show up NOW so you can be in a position to do something if recess ends.

My plea to Democrats in Congress is this: get back to Washington. Even if you can't gavel in from recess. Even if you don't have a quorum. Even if another war powers resolution vote fails. It's not enough to Tweet. Get inside the building and show the world you are trying. NOW!
