Surreal experience as someone who worked on EPA's original GHG endangerment finding. My main message today: EPA is taking the extreme position that the only way it can be consistent with congressional intent and Supreme Court decisions is to do *nothing* to curtail emissions of GHGs

I served as NOAA exec editor of the 2020 Arctic Report Card. Disappointing but not surprising that the current NOAA no longer supports this annual report of the most rapidly changing place on Earth. Arctic changes are important for weather, climate, commerce and national security.

The Supreme Court will be hearing a significant climate case in October. Suncor v Boulder County is about whether fed law precludes state-law claims seeking relief for injuries allegedly caused by the effects of GHGs on the climate. lnkd.in/ec5BAuCu

The proposal would focus political oversight on review of individual research proposals, consuming time that would better be used for high-level leadership. It assumes that political judgement can legitimately supersede objective assessment of merit by multidisciplinary expert peer review.

** OMB has not fully considered the economic impacts of the proposal. ** The proposal purports to “restore gold standard science” and promote scientific integrity, including transparency and independent (unbiased) peer review. However, it is difficult to see how it would achieve these objectives.

Agencies cannot simply delegate to OMB their respective authority. These agencies have their respective statutory requirements to implement congressionally-mandated programs, some of which explicitly require scientific peer review to take precedence over political reviews.

OMB asserts they have the authority to promulgate this regulation by citing statutory language which states that the Deputy Director Manager is able to 'provide overall direction and leadership to the executive branch on financial management matters' but the proposal goes far beyond financial mgmt.

The proposed OMB rule Regulation for Federal Financial Assistance is getting the attention it deserves. Thousands of comments were submitted by yesterday's deadline. The Environmental Protection Network submitted a comprehensive set of comments for anyone interested in a critique of OMB's proposal.

Yes, they recently finalized a decision repealing the endangerment finding. That will be litigated. You could still have a climate adaptation program even without the endangerment finding.

EPA did that very formally in 2009 with the GHG endangerment finding under the Clean Air Act. But yes, you have to acknowledge that there's a problem worth adapting to in the first place.

I was interviewed for this article. We thought climate adaptation work at EPA would be supported. It's always been and from my experience still is bipartisan. You prepare for change. It's as simple as that. www.eenews.net/articles/ada...

The EPA administrator once touted the importance of climate adaptation programs. Now that he's in charge, he's taking a different approach.

I've now wrapped up my first ever class teaching global climate change at Howard University. It was a lot of work doing it for the first time but very fulfilling. The students are great, am proud of the work they did, and am wishing them all the success in the world for the road ahead.

EPA's previous analyses showed large net benefits. For the medium/light-duty rule alone, monetized benefits using SCC were on the order of $72B. Yes, now those benefits are assumed to be zero. Couple of us ex-feds who worked on 2009 finding have our commentary here substack.com/home/post/p-...

Our EPA decrees it has no authority to regulate greenhouse gases with already-rejected arguments, creativity under the Clean Air Act, and with no basis to invalidate the 2009 endangerment finding.

The Supreme Court, not the Obama EPA, ruled that GHGs are air pollutants under the Clean Air Act. The first draft tech support doc with all supporting science that eventually supported 2009 finding was released for public comment under the Bush Admin.

Today's EPA statement says that the endangerment finding was overreach by the Obama Admin. Actually, this process dates back to 1999 when EPA was petitioned to regulate GHGs under the Clean Air Act. That led to 2007 Mass v EPA Supreme Court decision which directed EPA to make a science-based finding

EPN pointed out in their comments that the rules EPA is rescinding have positive net benefits. The Clean Car Rule avoids over 3,000 deaths and has annual net benefits of $96 billion. The Clean Truck Rule (phase 3) will save over 100 lives and has annual net benefits of over $10 billion.
