Demis Hassabis' FINRA proposal is also a lousy model. Broker-dealer codes of conduct are nothing like evaluating the safety of pervasive, powerful software products like frontier models. They should be overseen and inspected by a funded government agency, more like the SEC or the FDA. 5/6

The industry's proposals for self-regulation leave me cold because the economic relationship between AI companies and the standards / evaluator body reminds me of the Enron / Arthur Andersen scandal, where the accounting firm’s financial incentives led it to turn a blind eye to rampant fraud. 4/6

We have tried to govern software safety with market forces and liability. Construction used to be like this. Cities burned down and bridges collapsed. So now we require licensed architects, stamped plans, and expert inspections before occupancy. "Building codes are written in blood." 2/6

This might sound ridiculous, but we are already being shunted toward nationalism and identity checks: forcing ByteDance to sell US Tiktok and requiring proof of age to access social media. Even the EU right to be forgotten, while well-intentioned, means the Internet changes by jurisdiction. 3/4

You would have to fragment the Internet (like in China or Iran) to stop people from sharing ideas and building relationships across national borders. Imagine being asked for proof of citizenship to join UK Instagram, or needing a passport to watch a Canadian video on YouTube. 2/4

This was another factor in my decision to leave Google. I don’t mean to say that I don’t believe in dialogue or compromise. But when the opposing side in every debate is “don’t rock the boat,” and you can’t proceed until everyone is satisfied, the results are often neutered and boring. 3/4

We also urgently need independent, rigorous audit standards for privacy and security of online identity data. Trusting the same company that gave us the Cambridge Analytica scandal to grade their own homework on this front is a bad bet. 5/5

That's why legislators urgently need to act now. A new law, preferably at the federal level, should convert the independent auditor into a strong, permanent regulatory oversight body, funded with annual fees on big tech companies in proportion to the size of their business and impact on society. 4/5

We do not mean to suggest this agreement is not a positive step. Its weaknesses are not failures of negotiation, but rather a reflection of the limits of a legal settlement: a bargain with one company, for a fixed period, based on specific legal claims at the time of agreement. 3/5
