Once again I ask why the California Privacy Protection Agency has an ordered agenda for meetings if they routinely jump around out of order. Going into the closed session right away? Perfectly fine! The district court in this case applied strict scrutiny to a prohibition on targeted advertising to minors, and in this instance, held that the provisions were likely to fail strict scrutiny. Seems like a big deal tbh. www.thefire.org/news/victory...

And worth noting that last summer's Moody decision came up, highlighting that NetChoice has a more difficult job now in bringing a pre-enforcement facial challenge. I think that will be a consideration in whether the preliminary injunction is granted, and which parts of the law it'll cover.

The hearing went on for 4+ hours but the sense I got is that while the entire law is unlikely to be enjoined at this stage, the severability question seems really up in the air, and there are still significant constitutional questions with the AADC.

A key part of this hearing was getting into the severability of the statute. Bc the DPIA provision is enjoined, this means companies could not avail themselves of the 90 day right to cure. Lots of discussion of the legislative history and whether AADC would've passed without the right to cure.

State kept emphasizing that TECHNICALLY it says either estimate the age of child users "with a reasonable level of certainty appropriate to the risks that arise from the data management practices" OR apply child-friendly protections to everyone. Judge said "or" is a really bad part of the statute.

- And related to the record, the judge generally was interested in exploring non-social media applications of the law and it seems like the record maybe doesn't support those as well. Recall that the California AADC applies to ALL services likely to be accessed by children under 13.

- Judge explicitly noted that she's unlikely to enjoin the dark patterns provision, not necessarily on substance but that there's not enough in the record. And as a fun aside, she mentioned that "dark patterns" is a terrible word.

Two years ago, it was exclusively conservative states like Utah and Arkansas introducing legislation to require teens to get parent consent for social media. This year, I'm seeing the trend in blue, red, and purple states and it doesn't seem to be a "Republican idea" anymore.

- the proposed expansion of the internal operations exception to processes that would “encourage or prompt” a child’s use of an online service. The FTC agreed with commenters who argued this was overly broad and would constrain beneficial prompts and notifications. FPF was quoted here which was cool

what’s not there? - nothing that the FTC asked about in the more general question section, such as if avatars or screen names should be personal information - the entire proposed section on edtech and schools. The NJ Division of Consumer Affairs posted an FAQ about their new privacy law, which goes into effect v soon, and I can’t tell if this is an error or if this is how they interpret the statute’s requirements re: teen data.

Speaker Johnson wants a win for Trump on KOSA. From a news conference today: "We are very optimistic that if it's not done this year, that we can do that early next year with our Republican majorities because it's the Republican party that has been working aggressively to protect children online."
“Yeah, it's a really important issue. As a parent, I'm very passionate about protecting children online. As a professional, as a lawyer, in my career as a legislator, I've made this a big part of my work. My life's commitment is to protect children. And we've been doing that. 
We have to take some initiative on this. There's been some great work done on KOSA. As you know, there's still some concern about the free speech and whether it might lead to further censorship by the government of valid conservative voices, for example. So, we're working through all that. 
I'm grateful for the hard work that's been done. I'm grateful for the support behind it. I certainly I think all of us, 100% of us, support the principle behind it. But you’ve got to get this one right. When you're dealing with the regulation of free speech, you can't go too far and have it be overbroad, but you want to achieve those objectives. So, it's essential that we get this issue right. 
We are very optimistic that if it's not done this year, that we can do that early next year with our Republican majorities because it's the Republican party that has been working aggressively to protect children online. We lead on this and will continue to lead on.”

I read the newest Kids Online Safety (and Privacy) Act so you don’t have to. Tl;dr: the biggest change is the duty of care got some additional “reasonable person” type language, a new type of harm, and a new disclaimer that it can’t be used to violate 1A. Read my LinkedIn post for more!
