The NHS is also harmed. Where no claim is made it cannot recover the victim’s treatment costs from the wrongdoer. This is already having a significant impact - since 2021, NHS finances have been hit by almost £300 million because of the collapse in motor injury claims.

The growing justice gap in personal injury affects all of society, not just injured people. A drop in compensation claims increases the amount the Government spends on benefits, for example. Compensation provides rehabilitation, helping people get back to work.

APIL had further discussion with the MoJ yesterday on medical reporting organisation fees and the potential consequences of the JXX v Archibald judgment. Both sides in the case are appealing the decision. We will continue dialogue with the MoJ on how this judgment is affecting claimants and firms.

The Court of Appeal has overturned the decision in Mazur, in a judgment handed down today. It means that an unauthorised person can conduct litigation under the supervision of an authorised lawyer. APIL intervened in the appeal by CILEX. #Mazur #Litigation #Appeal

Children are no longer excluded from 'lost years' damages as the Supreme Court has overturned the decision in Croke v Wiseman. The decision in Croke v Wiseman was out-of-step with the principle of full compensation and is in conflict with the notion of treating all equally.
