How would you even prove that a juror isn't "following the law" in deliberations without violating Rule 606(b)? "A mistrial . . . is not to be avoided by intrusion into the jury's domain . . . [simply because of] an unreasonably stubborn or eccentric juror." 467 N.E.2d 1340 (Mass. 1984)

It's pencils down at the hackathon. I put 236 years of US copyright law into a git repository. Every Act of Congress from 1790 to today is a commit. Still some work to be done, and things got frantic at the end, but I'm proud of this! github.com/katelynsills...

Some profs are using AI to write articles. @mbkplus.bsky.social and I size up this worrisome trend and its impact on the academic enterprise. @mbkplus.bsky.social proposes granular disclosure rules whereas I foresee a world where AI will soon write articles and make the publishing decisions. Gulp.

One fascinating trend in this data. In 1971 alone, the Supreme Court cited 138 student notes and comments in its opinions. But that number has dropped off dramatically, as the Court hasn't cited more than 10 in a single term since 1997.

At its zenith, Evidence was one of law’s most celebrated fields. Since the FRE’s codification, however, the field has fallen to dead last in citation rankings. But a remnant of its former glory remains, as Wigmore (#2) and Greenleaf (#7) *still* appear on a list of SCOTUS’s most cited scholarship.

I'm honored to be publishing this piece with Vanderbilt Psych Prof Sarah Brown-Schmidt in volume 112 of the Virginia Law Review. In this empirical evidence law and cognitive science article, we identify the risks posed by "hear-witnesses" who inaccurately recall and recount statements at trial.

After surveying the divergent perspectives of all nine justices, I came to two conclusions. First, the era of reliability principles in Confrontation Clause jurisprudence is well and trial over. Second, the post-Crawford primary purpose test is safe, but for differing reasons.

I just bought this photo, simply labeled "Old Judges," at an estate sale for $3. Little did the seller know that it's actually an original, official portrait of the Fuller Court from its Lochner term. That means, if my calculations are correct, I'm looking at an appraisal value of *at least* $7.

One of the more trivial annoyances I have with AI is the widespread skepticism it’s brought to em-dashes. I love em-dashes! I’ve used them liberally in my articles for a decade. But now, I avoid them when writing, given their association. Not the worst consequence of AI, of course, but a bummer.

I often return to this amusing anecdote from Thomas Grey. Amid the heyday of formalism, the Harvard faculty threatened to withhold support for the University of Chicago's fledgling law school because Chicago planned to offer courses on "unscientific" public law topics like . . . Constitutional Law.
