Yes. AG Garland totally screwed up by not opening an investigation into Trump's incitement of insurrection (18 USC 2383) right after Trump committed that crime -- a crime, that upon conviction, in addition to prison, would have barred him from holding federal office.

That means any "detention" of any mere "toucher" violates the Fourth Amendment which, according to the SCOTUS in Terry, requires "reasonable suspicion" that the detained person committed a crime or was about to commit a crime.
