I haven't seen that as much, perhaps it depends on the position. Or the institution.

I don't think that's quite it. I think that increased institutional demands require administration, and it's work that scholars don't want to do and aren't good at. The pliability is more likely part of the bureaucratic mindset than literally you'll be fired if you don't do [whatever].

Do you recall the nameplates outside professor offices used to say Mr. [Lastname]? Anyway it seems to me that the formality will never die, at least not on the East Coast.

That would be cool! Maybe I am still smarting from the one comment "she doesn't know anything about torts" when of course a 1L would definitely be in a position to judge.

You're going to hate me for this but I'd be interested in the gender/age intersection. Evaluations are nice tests of customer satisfaction and bias but otherwise not useful.

I don't feel good about your getting explitive filled rants, I am sorry that happened. That is highly inappropriate no matter who is writing, more so if that person might be a person to review your work.

I think there is some truth to what you say, in the sense that tenure is supposed to give you license to critique, and to get it your work has to be reviewed by senior people, so maybe tweaking their noses isn't the smartest move. Whereas a well thought out L.Rev. critique is very "in the box."

For those unfamiliar, in 1991 when this article was written Posner and Shavell were the top dogs of the legal academy in the then-dominant field of theoretical law & economics.

In fact criticizing established scholars is a classic approach to making your mark in the academy -- see, e.g., John Donohue, "Opting for the British Rule, or If Posner and Shavell Can't Remember the Coase Theorem, Who Will?"

Rudimentary question about the shadow/interim/emergency/applications docket: What's the statutory authority for the SCOTUS (or one Justice) to stay a lower court's preliminary injunction or other interim (non-final) relief, where the predicates for the All Writs Act aren't satisfied?

But I don't think the ALI restatements were ever about academics, although some participated. The audience is (I thought) state court judges. And the stakeholders are lawyers on various sides of an issue, even if they are supposed to leave clients at the door.

I think that the pendulum is swinging the opposite way - that there is more interest in practical law among young academics. More concern about impact.

You might consider that how you perceived your professors in law school was not how you might see them today, after a bit more experience. You should know that you initially seemed to be arguing for put it all out there political teaching.
