The Greek government offering an authoritarian and imperialistic government a universal symbol of democracy to use it as a prop is probably the saddest among the many horrendous things they've done

If the interests of the powerful are made into law, then I certainly prefer the rule of men and women rather than the rule of law

Indeed. Yet, constitutionalism doesn't work everywhere nor always. When in Rome, do as the Romans do. Elsewhere, doing it as the Romans might not be the best option

Despite being a member of the EU, #Greece is clearly a (what would have been called) Third World country. One can remark myriads of instances of -subtle, or not so subtle- #neocolonialism. Universities are among its many targets

"Tushnet and Bugarič propose a 'thin' idea of constitutionalism and suggest that we should scale back our expectations for what constitutionalism can achieve. Political mobilization, led by people attuned to the economic and cultural causes of democratic backsliding, is a better bet" Well said!

Legal Theory Bookworm: “Constitutionalism and Its Discontents” by Tushnet & Bugarič
The Legal Theory Bookworm recommends Constitutionalism and Its Discontents by Mark Tushnet and Bojan Bugarič. Here is a description: In the early twenty-first century, constitutionalism confronts numerous pressures and critiques.  Some prominent critics are concerned that constitutionalism’s modern form, in which high courts play a large role, limits popular self-governance. By committing their nations to detailed social and economic policies―from neoliberal requirements for balanced budgets to constitutionalized social welfare and environmental rights―many modern constitutions might make promises they cannot keep and be unduly rigid in the face of changing social, economic, and environmental conditions.

Wall on the Critical Legal Praxis of Costas Douzinas
Illan Rua Wall (University of Galway - School of Law) has posted ‘The Critical (Legal) Praxis of Costas Douzinas’ on SSRN. Here is the abstract: Douzinas’ work is made up of shards of critique that lacerate structures of power, legal orders, political regimes and economic apparatuses. Piecing these shards together does not give us a complete theory, but this chapter argues that it does contain a singular critical praxis.

Yes, #RepresentativeDemocracy isn't working. Nevertheless, it isn't working bit better in some cases than others. No Greek PM has resigned since August 2015. Six UK PMs have done so (Cameron, May, Johnson, Truss, Sunak, Starmer). For far less than the series of colossal scandals plaguing #Greece

Representative democracy does not work. (For 99% of the people. It works perfectly well for the 1%). No electoral reform can fix it. Changing electoral attitudes may have immense impact, though. If we all vote for candidates that are not richer than ourselves, the result would be spectacular

You keep electing whoever rich people tell you to (rich people themselves, too) -because you believe their money, watch their media etc- and then you complain when they advance rich people's interests instead of ordinary people's. How stupid is this? (and are you?)

Speaking of #LegalEducation: Current super-intensive Law School #curricula just stuff students' heads with information. Wich is not knowledge. The more time students devote to studying (=reading) the less they do to thinking. Result: people unfit for reasoning. In extremis, educated fools

Well my argument has been (or is becoming) that the Constitution has already failed, a subject I'm actively working on. But just ask this question. Assume we had another convention--would each state still have an equal vote? On this point, see washingtonmonthly.com/2025/09/17/c...

Forbath and Fishkin on Anti-Oligarchy, Anti-Authoritarianism, the Constitution, and the Court
William E. Forbath (University of Texas at Austin School of Law) and Joseph Fishkin (UCLA School of Law) have posted Anti-Oligarchy, Anti-Authoritarianism, The Constitution, and the Court on SSRN. Here is the abstract: In the 1930s, like today, our nation faced a crisis of oligarchy: too much wealth and political power concentrated in too few hands. Like today’s liberals and progressives, the New Dealers aimed to enact social and economic reforms that would ensure a much broader distribution of wealth and power, but they faced a hostile, right-wing Supreme Court that would certainly thwart such reforms.

Yes, corrupt politicians don't go to jail, they go home, as someone said. But we don't live in such times anymore. When democracy is fatally wounded, it can only survive if corrupt politicians go to jail en masse. Oppositions that don't get this will remain in opposition. And incumbents out of jail

As great as they are, theorists like Rawls, Habermas, or Dworkin have been (mis)understood by generations of jurists as calling for the juridification of the political. The liberal fallacy -myth, indeed- of law protecting, even creating, democracy has currently left mainstream legal analysts >
