Three cheers for the Constitution's right to a jury: a federal jury in Los Angeles "took just over an hour to acquit [Brayan] Ramos-Brito of a misdemeanor assault count" in an ICE-scuffle case hinging heavily on the testimony of border sector chief Gregory Bovino, now doing raids in Chicago.

Incredible scoop! Career officials inside the Trump administration first viewed the case of Mr. Abrego like any normal case of a wrongful deportation — they began looking for ways to bring him back, as happens normally when ICE makes mistakes. Then the White House got involved, and blew it up.
Late last month, three days after Abrego Garcia’s family filed its lawsuit over his deportation, government attorneys began discussing how to undo the mistake and bring him back. In their conversations, officials went so far as to float the idea of having the U.S. ambassador to El Salvador make a personal appeal to the country’s president for Abrego Garcia’s return. But first, the State Department’s legal team wanted more information from DHS about his alleged role in the MS-13 gang. The thin evidence supplied in response was met with skepticism from the State Department lawyers. Abrego Garcia, who came to the United States illegally when he was 16 years old, was one of 23 Salvadorans deported on March 15. But his name had not appeared on an internal list of 10 gang members sought by President Nayib Bukele.
Attorneys at DHS had other concerns. They were aware that, six years ago, a judge had granted Abrego Garcia protected status over fears that he could be targeted for violence should he be returned to El Salvador. That protection was still in effect and had been violated by the March 15 deportation. They wanted to know if U.S. diplomats could ask the Salvadoran government to keep him separated from Barrio 18 gang members who had threatened him in the past and might harm him.

so they’re really going with the “keep a habeas petition in your pocket just in case you get disappeared” theory of due process, huh?
10. As part of the notice procedure, the alien is informed that he or she can make a telephone call to whomever he or she desires, including legal representatives. ICE ensures that telephones are made available for the aliens and that the aliens have access to the telephone lines.
11. Although there may be fact-specific exceptional cases, in a general case, after an alien is served with Form AEA 21-B, the alien is given a reasonable amount of time, and no less than 12 hours, including the ability to make a telephone call, to indicate or express an intent to file a habeas petition. If the alien does not express any such intention, then ICE may proceed with the removal, though such removal may not actually occur for many more hours or days, giving the alien additional time to express an intent. If the alien does express an intent to file a habeas petition, the alien is given a reasonable amount of time, and no less than 24 hours, to actually file that petition. If the alien does not file such a petition within 24 hours, then ICE may proceed with the removal, though such removal may not actually occur for many more hours or
days, giving the alien additional time to file the petition. Further, because aliens subject to the AEA are often detained for several days before removal, they frequently have much more time to express an intent to file a habeas petition or to actually file such a petition. Moreover, these timeframes are consistent with, if not more generous than, the timeframes used for expedited removal procedures under Title 8.

Yet ANOTHER story of a Venezuelan man ripped away from his family in the U.S. because of his tattoos; in this case a tattoo of a rose and a tattoo of a crown. It’s been three weeks and his wife and kids have no idea what’s happened to him. Like others, El Salvador is holding him incommunicado.
In the early hours of January 29, 2025, the famly went to a regular check-in appointment with ICE in Charlotte. Luz, who was pregnant at the time, says when an officer called Zambrano Perez's name, they didn't suspect anything because he had never had issues before. But, then the office started asking him if he was involved with any criminal group and inquiring about his clothing and tattoos. Zambrano Perez has a tattoo on his hand of a crown with his name on it that he got when he was 15 years old. He has another tattoo of a rose.

BREAKING: Chief Judge Boasberg denies the federal government's effort to vacate the TROs in the Alien Enemies Act case, finding that people the government claims are subject to the proclamation at least have a right to "individualized hearings to determine whether the Act applies to them at all."
The Court need not resolve the thorny question of whether the judiciary has the authority to assess this claim in the first place. That is because Plaintiffs are likely to succeed on another
equally fundamental theory: before they may be deported, they are entitled to individualized hearings to determine whether the Act applies to them at all. As the Government itself concedes, the awesome power granted by the Act may be brought to bear only on those who are, in fact,
"alien enemies." And the Supreme Court and this Circuit have long maintained that federal
courts are equipped to adjudicate that question when individuals threatened with detention and
removal challenge their designation as such. Because the named Plaintiffs dispute that they are
members of Tren de Aragua, they may not be deported until a court has been able to decide the
merits of their challenge. Nor may any members of the provisionally certified class be removed
until they have been given the opportunity to challenge their designations as well. The Motion to
Vacate will thus be denied.

NEW: The ACLU has filed a sworn declaration from a Venezuelan woman who ICE sought to turn over to El Salvador under the Alien Enemies Act, who declares that "I heard two US government officials talking and they said 'there is an order saying we can’t take off but we already have.'"
Declaration of S.Z.F.R. 1. I am a woman from Venezuela and I am in detention at Webb County Detention Center in Laredo Texas. My initials are S.Z.F.R. 2. On March 9 at 7 a.m. I was in my dorm in El Paso and was told to get my things together and I was being transferred to another facility. There was one other woman and 14 men who were also transferred with me. 3. I was supposed to have a merits hearing for my asylum claims on March 10th. 4. They took me to the airport in El Paso and I was put on a plane. Already on the plane were many Venezuelan men and three other Venezuelan women. We flew to Laredo. 5. When we got to Laredo we met up with another group of Venezuelan men. 6. There were at least 10 Venezuelan women on the plane. We arrived March 9 in Laredo and were taken to Webb County Detention Center. 7. Thursday of last week, March13th, we were told to gather our belongings and we were driven toward the airport for about an hour. We were told we were being deported to Venezuela. We never made it to the airport. We were sent back to Webb and told it was because of a plane malfunction. 8. On Friday again we were told to gather our belongings and put on the bus at Webb and sat on the bus for about 15 minutes and then were taken back to Webb. 9. Saturday morning we were again told to gather our belongings and get on the bus. We went to the airport and 8 women were put on the plane with me.When we got on the plane there were already over 50 men on the plane. I could see other migrants walking to the plane but we took off before any additional people boarded. 11. Within a couple of minutes of take off I heard two US government officials talking and they said “there is an order saying we can’t take off but we already have.” 12. I asked where we were going and we were told that we were going to Venezuela. 13. Several other people on the plane told me they were in immigration proceedings and awaiting court hearings in immigration court. 14. We were not allowed to open our window shades. 15. We landed somewhere for refueling. We were there for many hours. We were arm and leg shackled the whole time. 16. We took off again and landed fairly quickly. I was then told we were in El Salvador. 17. While on the plane the government officials were asking the men to sign a document and they didn’t want to. The government officials were pushing them to sign the documents and threatening them. I heard them discussing the documents and they were about the men admitting they were members of TdA. 18. After we landed but were still on the plane a woman opened the shade. An officer rushed to shut the shade and pushed her down by her shoulders to try and stop her from looking out. The person that pushed her down had HOU-02 on his sleeve. 19. I saw out the window for a minute and I saw men in military uniforms and another plane. I saw men being led off the plane. Since I’ve been back in the U.S. I have seen news coverage and the plane I saw looks like the one I’ve seen on TV with migrants from the U.S. being delivered to El Salvador.20. All the men got off the plane. The remaining women asked what happens to us? I was told that the President of El Salvador would not accept women. I was also told that we were going back to detention in the U.S. 21. We left in the middle of the night and landed in the early morning in Laredo. The 8 women who were on the plane were all returned back to the U.S. /s/ S.Z.F.R. S.Z.F.R.

A US-born citizen was walking near Chicago in January. ICE snatched him off the street, handcuffed him, threw into a van. His wallet, which contained his ID, was confiscated. He was detained for 10 hours before being released without a record of what occurred. immigrantjustice.org/sites/defaul...
A screenshot from a court filing reads, in part:

"Julio Noriega is 54 years old, was born in Chicago, and is a U.S. citizen.

On January 31, 2025, he was walking near the corner of Cermak Road and Harlem Avenue in Berwyn, Illinois, handing out his resume to local businesses.

As he walked out of a Jiffy Lube, he was approached by ICE officers who grabbed and handcuffed him and put him into a van, without an opportunity to explain his citizenship.

The officers drove Julio and others around for more than an hour before bringing him to an ICE processing center, where he remained, still handcuffed, for several more hours.

All the while, Julio had a wallet containing identification that ICE had confiscated.

The officers never showed Julio a warrant, and they did not ask him any questions to ascertain whether he was a noncitizen or a flight risk.

After about 10 hours, ICE officers reviewed the contents of Julio’s
wallet, realized he was a U.S. citizen, and released him with no money and no paperwork."
