Closing the accountability gap for AI Search: Why DSA Risk Assessments Cannot Work Without AI Act Transparency - DSA Observatory

Buse Çetin (AI Forensics) and Natalia Stanusch (AI Forensics, University of Amsterdam) The European Commission's designation of ChatGPT as a Very Large Online Search Engine and the Digital Omnibus's coordination provisions mark progress in AI Search regulation, but leave critical gaps that can be exploited. Without mandatory coordination and documentation requirements, regulators would be unable to assess whether mitigation strategies are adequate. We propose the following measures using existing authority: mandatory AI Act documentation for DSA assessments, joint review procedures, and expanded moderation definitions including pre-deployment design choices.

⚖️ Last week, we welcomed the designation of ChatGPT as a Very Large Online Search Engine under the Digital Services Act. But we also cautioned that there is a continued need for stronger coordination around AI Search, which straddles both the DSA and the AI Act.

Hugging Face told @mattburgess1.bsky.social in @wired.com that it is working to address a “gap” in safeguard adoption by some developers. The company also said that platform-wide prompt and output filtering would not be technically feasible.

• 73% of monitored requests were sexual in nature. • Of those, 83% sought to undress or sexualize a person. 95% targeted women. • 6.7% targeted a minor. If fulfilled, these requests would constitute CSAM. • Just 3% of audited Spaces showed evidence of output moderation.

Last week's EU ban on AI nudifiers was one of few positive outcomes from the "simplification" process that culminated in the Digital Omnibus package. But as our researcher Silvia Semenzin noted recently in @techpolicypress.bsky.social, a ban alone cannot be the final answer to TFGBV.

However, after sharing our findings with Snap’s DSA Compliance Team, Snap’s engineering team was able to address the rate limiting issue. ✅ A fix, deployed on April 29, led to service availability rising from almost 0% to nearly 100%. The two other issues must still be addressed.

On Snapchat, we found: ❌ The platform’s Ad Gallery was searchable only by advertiser name. ⚠️ The repository was unavailable 99.7% of the time during the observation period. 🏷️ Commercial communications were not labeled as such on the web.
