Alex Botoman @abotoman.bsky.social · 25/09/2026Those seem like two sides of the same coin. Surely a state is entitled to determine on a statewide basis whether its law enforcement officers will cooperate with ICE? 170

Alex Botoman @abotoman.bsky.social · 22/09/2026I’m confused about everything going on procedurally here. How can a court of appeals order a district court to enter final judgment on an appeal from a TRO? 241
Alex Botoman @abotoman.bsky.social · 22/09/2026Extremely confused how a court can enter a permanent injunction before the defendants have even responded to the complaint 000

Alex Botoman @abotoman.bsky.social · 07/09/2026I guess you still have to teach it because the bar exam still makes people memorize elements of crimes. And basic concepts like mens rea are important. But we spent a huge chunk of my class on different degrees of murder, when in the real world, those crimes are defined by jx-specific statutes 120
Alex Botoman @abotoman.bsky.social · 07/09/2026I’ve often wondered why substantive criminal law is the mandatory course. As someone who now practices criminal law, crim pro is easily the more practically applicable course. These days, the elements of crimes are mostly defined by statute, and there are easy ways to look them up 581
Alex Botoman @abotoman.bsky.social · 04/09/2026Is he giving them permission to claim to be him? If yes, that’s bad. If no, that’s also bad and he should put a stop to it 010
Alex Botoman @abotoman.bsky.social · 04/09/2026I’ve been wondering if the reason Main Justice vetoed a section 242 charge is that it would mean acknowledging that people in the unlawfully have constitutional rights 010
Alex Botoman @abotoman.bsky.social · 03/09/2026Doesn’t even seem like this is a leak. Seems like the AUSA told this directly to the attorneys for the victim 1170
Alex Botoman @abotoman.bsky.social · 20/08/2026There is precedent for advance confirmations like this, but they raise a lot of questions and are ripe for abuse 100
Alex Botoman @abotoman.bsky.social · 20/08/2026There is a good chance that this is what Justice Alito has in mind. If Democrats win the Senate, he announces his retirement effective some future date, and Republicans can still confirm his replacement during the lame duck period. 112
Alex Botoman @abotoman.bsky.social · 14/08/2026I’d also put it into the category of a frivolous argument. You’re asking the court to resolve the case on a ground that has nothing to do with the law 010

Alex Botoman @abotoman.bsky.social · 29/07/2026The U.S. Attorney is just an executive branch officer. Courts decide the validity of executive appointments all the time. The fact that the person is physically located in the district and practices in that court doesn’t seem to me to come close to hitting the normally high bar for recusal 120
Alex Botoman @abotoman.bsky.social · 29/07/2026It’s been done in every one of these cases, but the idea that the judges of a district have to recuse from deciding whether their district’s U.S. Attorney is validly serving seems made up and a bit ridiculous. I can see it more here where the court appointed him, but Bastian didn’t vote on that 120

Alex Botoman @abotoman.bsky.social · 23/07/2026Yeah, I’m actually not sure this order does anything to district courts. It grants a stay in a specific case without providing any reasoning. If anything, it could be seen as a rejection of the government’s request to say something in a published opinion that would foreclose claims in other cases 140

I think a firm could do very well prioritizing hiring these semi-known commodities over unproven 1Ls. But the biggest firms are too risk-averse to try it 010
Alex Botoman @abotoman.bsky.social · 22/06/2026I agree with this. I also think it’s kind of unsavory because it often results in the dissenting judge predicting what the en banc court will do before they’ve even heard argument 010
