Headline
Mr Justice Chamberlain has today rejected a challenge to regulatory decisions in relation to the PATHWAYS clinical trial for puberty suppressing hormones ("PSH").
Background
In 2020, NHS England commissioned the paediatrician Dr Hilary Cass (now Baroness Cass) to chair a review of gender identity services for children and young people. A central finding of what became known as the Cass Review was that the evidence base for the use of PSH in children and young people with gender incongruence was very weak.
NS England and the Secretary of State commissioned a clinical trial designed to address the "evidence gap" identified by the Cass Review: the Puberty Suppression and Transitional Healthcare with Adaptive Youth Service or "PATHWAYS Trial". The Trial was co-sponsored by King's College London and the South London and Maudsley NHS Foundation Trust. They are interested parties in this case.

The sponsors submitted an application for regulatory approval in August 2025. Approval was given in November 2025 by the Medicines and Health Regulatory Agency
("MHRA") on behalf of the Secretary of State and by the Health Research Authority
("HRA"). The Secretary of State and the HRA are the defendants in this case.
There were then two developments. A group of clinicians wrote to the regulatory authorities to express their concerns and the Secretary of State for Health and Social Care announced a pause on new prescriptions for masculinising and feminising ("MAF") hormones for young people.

The second claimant, Keira Bell, has personal experience of treatment for gender dysphoria and is a long-standing campaigner on issues relating to such treatment. She has brought litigation in the public interest before.
The third claimant, James Esses, is a practising psychotherapist and founder of the organisation Thoughtful Therapists and Just Therapy. He is an advocate for evidence-based treatment for gender dysphoria.
The claim
10 The claimants initially challenged the November 2025 decisions of the MHRA and HRA on five grounds. With the permission of the court, they amended their claim to add a challenge to the June 2026 decisions. They also made an application for an interim order to stop the Trial from going ahead while the case was considered.
Procedure
11 In judicial review, claimants require the permission of the court to proceed to a substantive hearing. In this case, the Court ordered that the application for permission to apply for judicial review should be considered at a hearing together with the application for an interim order.

The hearing took two full days on 27 and 28 July 2026. In advance, the parties filed including 31 witness statements, detailed written submissions and authorities. The documentation ran to over 13,000 pages.

Summary of reasons

The judge's reasons can be summarised as follows:
(a) The Trial was commissioned by NHS England and designed by its co-sponsors with conspicuous care, in consultation with other expert bodies. The participants will be children with persistent gender incongruence who are receiving treatment from specialist gender services. Each child will have been assessed over many months by specialist doctors. In each case, the treating team will have formed the opinion that the child has a reasonable prospect of receiving a clinical benefit from the treatment. There is a detailed process to en…question of ethical approval to a Research Ethics Committee ("REC") including both paediatric consultants and lay people. The REC gave that approval in November and, having reconsidered the position in the light of subsequent developments, affirmed its approval of the modified protocol in June 2026.
(C)
Where regulatory functions have been conferred on a specialist regulator with technical or scientific expertise, it will generally be because the function is best performed by persons who have been trained in the scientific method. In assessing an application for approval in a context such as this, the specialist regulator can use its prior experience to spot gaps, ask probing questions and evaluate the responses.
If the regulator's decision is challenged on rationality grounds in judicial review proceedings, the court must be very cautious about interfering with that decision.
The Court's function is not to say whether it agrees with the decision under challenge, but rather to examine whether the defendants have exercised their functions contrary to the legislative scheme or otherwise unlawfully. These
principles apply to both regulators whose decisions are challenged here.
(d) The claimants advanced their challenge to the HRA's and MHRA's November 2025 and June 2026 decisions under five grounds. After careful examination, none of them is arguable with a realistic prospect of success:
(i)
In its June 2026 decision, the MHRA properly recognised that the likelihood that trial participants would have access to PSH and/or MAF hormones after their participation in the trial came to an end ("the destination therapy issue") was critical to its decision. Its conclusion, taking account of that issue, was rational. The MHRA rationally concluded that "[s]ome direct benefit for the group of patients involved in the clinical trial is to be obtained from that trial". The HRA's research ethics committee ("REC") did not fail to take account any of the relevant matters identified by…the benefits and risks of PSH. Whether to approve a trial with this purpose was quintessentially a question of judgment for the MHRA and HRA.
The regulatory regime imposes a duty on the MHRA to give reasons in some circumstances, but not when it approves a clinical trial or the modification of a trial protocol. There are no particularly strong policy reasons to impose a common law duty. In any event, there would be no point in granting permission on this ground given that the claimants now have a vast amount of material explaining the MHRA's and HRA's reasons for the approvals and, by virtue of the publication this judgment, so does the public at large.
(e) Because none of the grounds of challenge has a realistic prospect of success, the question of interim relief pending a substantive hearing does not arise. Even if permission had been granted on one or more of the grounds which could lead to the quashing of the authorisations, interim relief would nevertheless have been refused. The harm that would be done to the public interest and the interests of Trial participants in the scenario where interim relief is granted but the claim later fails firmly outweighs any harm that might accrue to Trial participants in the scenario where interim relief is refused but the claim later succeeds.

It is important to note that the Code of Practice applies to services, public functions, and associations and not - for example - the employment setting. It is also important to be clear that this is guidance for duty bearers (usually organisations), not criminal law that applies to individual members of the public.

Dear Prime Minister,
We have all written to this government numerous times in the past year to warn you about the devastating impact of your approach to LGBTQ+ policy on the ability of trans people to participate in public life with dignity. This Government failed to act at any point to secure and defend trans people's fundamental rights and protections, and the current situation has become completely untenable for a rights-respecting nation.
The Supreme Court's job is to interpret statute, it is for our political representatives to set out a coherent vision for what the law should be and to make the law better. Even before the For Women Scotland judgment, the Equality and Human Rights Commission has acted in a way that has shredded our community's trust in regulators and institutions. This is not good enough.
The Code of Practice now before Parliament is set to crystallise an interpretation of the law that is fundamentally in conflict with the UK's human rights obligations. Many MPs have already spoken out about the unjust and unworkable situation the code would create, and more than a hundred have already used the limited available scrutiny process to oppose it.
We urge you to listen to these concerns. The Code does not provide clarity; it exacerbates confusion, conflict, and risk. We have consistently argued that a Code of Practice must pass three tests to be workable: it must protect trans people's ability to participate fully in society, support organisations that wish to remain inclusive, and comply with the UK's domestic and international human rights obligations. This Code fails on all counts.
Prime Minister, the everyday harms this causes will be wide-ranging. This will be viewed as Labour's legacy on LGBTQ+ rights for a generation.

You still have the opportunity to intervene - scrap this harmful guidance and change the law to fix the mess we find ourselves in.The government's own Equality Impact assessment outlines these consequences starkly, warning of discrimination, physical danger, and limiting trans people's access to vital services. Beyond just our trans communities, the assessment warns of the dangers of appearance-based gender policing on the safety of the public at large.
This Code of Practice could absolutely have been better within the current legal framework, and its current raft is dangerous and unacceptable. This is, however, also a symptom of the broader legislative probler acing our community and requiring action from our governmen
Last year's Supreme Court ruling turned Parliament's intentions for UK equality law on its head. It interpreted the Equality Act in a way that is clearly in direct opposition to decades of deliberate policymaking and well-documented intent. It has turned decades-old settled policy on how trans people should be treated into a mess of contradictory, harmful and incoherent rules.
The current Deputy Prime Minister, David Lammy MP, said this in response to a proposed amendment to prevent trans people accessing services in line with our gender identities when debating the Gender Recognition Act before it was passed more than twenty years ago:
“the Government entirely reject the implication of the new clause that transsexuals might set out to cause offence to others. That is not the Government's experience, and we therefore reject the new clause. The Government also believe that separate facilities for minority groups are objectionable, and we urge the House to reject the proposal."
Yet now your Government is set to approve a Code that not only condones that approach but encourages it as the norm across Britain. The Supreme Court said that their ruling would not be disadvantageous to or remove protection from trans people with or without a GRC", but the government's own impact assessment now makes clear that widespread harm is happening.

Not doing so is a political choice, and they cannot hide behind the courts in making it. As we go headfirst into becoming an outlier in the rights-respecting world, the picture is bleak – but it’s not too late to change it.

📑 What does that mean in detail? It’s clear that the FWS judgment has significantly damaged trans people’s rights, despite claims to the contrary. There are, however, differing interpretations and this will make a significant difference in everyday life. We will be watching closely.

🏛️ We all know what new guidance needs to do for it to improve this mess. This is our 3 point test for a new Code of Practice, if these basic needs can't be fulfilled by our Equality Act - it will no longer be worth of the name. We will keep pushing until we have equality. But we need your help ➡️
Defend trans people’s right to access spaces in line with their lived gender.
Bring the UK back into line with its human rights obligations.
The minimum we need from a new EHRC Code of Practice:
Protect inclusive spaces and freedom of association from anti-trans lawfare.

⚖️ One year ago, the Supreme Court promised us our rights were still protected. 🟰 Since then - our lives have become less free, less safe and less equal. Where is the dignity and respect in this? 📝 It's going to take more than minor tweaks to make a difference here. What happens now? ➡️
A year of hurt and harm.
We know what happened next.
They promised us this wouldn’t happen.
Today is one year since the Supreme Court said their decision wouldn’t cause any disadvantage to trans people.Our lives have become less free, less safe and less equal.
Trans people have been kicked out of bathrooms, forced out of workplaces, and outed against their will.
Both cis and trans people have experienced dangerous gender policing, putting their safety at risk.
Trans women and girls have been torn away from their friends, in groups that wanted to remain inclusive.
Where is the dignity? 
Where is the respect?For trans people to be meaningfully protected by equality laws, they must protect our ability to live our lives as ourselves as Parliament intended. Any changes to guidance from this government will need to be more than trivial tweaks to make a difference to the mess this ruling has created.
We need action from Labour to protect trans people, defend inclusive organisations and respect human rights - or we will see yet more years of legal protections being undermined and trans people harmed."

The Government’s draft ‘Keeping Children Safe in Education’ guidance is a threat to the safety and wellbeing of trans+ kids at school and college.Is this dignity?

Trans+ students will be banned from toilets and changing rooms that reflect their gender.

Schools and colleges will be allowed to refuse a child or young person’s request to socially transition.Is this respect?

Trans and non-binary students will be encouraged to not come out.

The proposals label all trans and non-binary children as ‘gender questioning’.

Campaign group Trans+ Solidarity Alliance described the news as “heartbreaking” for children.

They said: “Inclusive organisations being bullied into excluding people against their will is a profound failure of this Government to live up to its promises to the trans community.

“This news will be heartbreaking for the children and volunteer leaders that hold Girlguiding together, to fix a problem that doesn’t exist without anti-trans lawfare.”

Our take on the judgment: incoherent, unworkable and needs to be fixed or we face a workers rights crisis. We will be campaigning hard to fix this mess, watch this space.
“The legal situation for trans people, employers and service providers is now completely incoherent. What bathroom a trans person can use in a pub may now depend whether they are there as an employee or for a drink. We are pleased the court has confirmed that the Equality Act does not function as a bathroom ban, but outdated workplace regulations have failed to keep up with modern times and last year’s Supreme Court judgment has made them entirely unworkable. 

“This risks outing trans people at work, who may have been using gendered facilities without issue for years - and it is unclear how trans people without access to gender neutral facilities will be able to do their jobs.  This is a worker's rights crisis for the trans community, and one which will cause issues for employers across the country. 

“The High Court has clarified that trans people should not be forced to use facilities in line with their birth sex, but it is hard to see how treating us as a 'third sex' at work aligns with the privacy protections in the Gender Recognition Act or the Human Rights Act. We must be allowed to transition and move on with our lives with privacy, not be outed every day at work.”

"Wherever you stand, and whatever the courts decide while trying to make sense of this situation, it cannot be right that organisations who have been proudly trans-inclusive for years feel forced to change this due to a lack of clarity on how to remain inclusive and costly legal threats. And it cannot be right that trans people are forced to live a life where nowhere feels truly safe."

But the fact that publicly-funded groups have signed this letter has been criticised by women's groups. For Women Scotland wrote on X: "Why are @scotgov funding orgs to lobby for a roll-back of women's legal rights? Do they support any groups who adhere to the law? SG claims @InspiringSland makes the financial awards. So are they institutionally biased against women's rights groups? It's high time these decisions were subject to review!"

come forward to fill these essential committee roles. Without officers in place or a committee, Seven Hills
