In July, we released Courtney 50.0. It may not be the fastest writing machine, but it has been honed fifty years of intensive language training. Based on the benchmarks demonstrated by this chart, Courtney 50.0 crushes the competition so significantly that we should have used a log axis.
An incredibly long graphic, using the graphic in the post text at the very bottom (a chart showing Open AI vs Grok vs Fable release date on the X axis, and model number on the Y axis). There is a long piece of whitespace, and then Courtney 49.0 and Courtney 50.0 are graphed at the very top.

Freeman's counsel is like, "look at 30(d)(3) and one of the reasons listed is to enforce a limitation by the court, and the court said that this deposition was going to be about Freeman's ability to pay, so that's what I was doing!"
(2) Objections. An objection at the time of the examination—whether to evidence, to a party's conduct, to the officer's qualifications, to the manner of taking the deposition, or to any other aspect of the deposition—must be noted on the record, but the examination still proceeds; the testimony is taken subject to any objection. An objection must be stated concisely in a nonargumentative and nonsuggestive manner. A person may instruct a deponent not to answer only when necessary to preserve a privilege, to enforce a limitation ordered by the court, or to present a motion under Rule 30(d)(3).

Also she apparently is fucking around and not paying taxes in California even though she apparently lives there.
What she has instead
overwhelmingly demonstrated is a disturbing lack of credibility and candor (including to the IRS, as she claims to be and files taxes as a resident of Alaska, which has no state income tax, when she has
not even been there in five years and has, simultaneously, filed a homestead exemption on her
"primary residence" in California). (Id., pp. 11-12.)

Freeman doesn't know anything about what shows up on their tax returns, and didn't bother to check between the two depositions after being asked.
At both days of her deposition, Ms. Freeman was unable to provide any details about financial
accounts or tax returns, which was particularly conspicuous at the second session of her deposition,
after she had been previously asked about her tax returns at the first session and whether she had
reviewed them, yet still chose not to do so before the second session.

By the way, I left this off because I thought it was already sufficient to communicate the scathe at issue, but the second page of this says "and look if y'all need me to beat your ass going into Thursday, I will sit in on the deposition by telephone, so help you God."
FYI: I will not be in chambers after 5 PM EDT on Wednesday. If there are privilege objections asserted after that hour, you will have to come back on Thursday morning at noon (9
AM PDT) so that I can rule on them. There will not be any deferred procedures for resolving privilege issues. At that point the deposition will be completed in my (telephonic) presence. I do not care if this does not accord with your schedule. My schedule has not been of any particular
interest to Ms. Freeman and her attorney up to now; my schedule controls now.

Anyway Judge McMahon's answer is "well if there's a problem, you fucking call me and give your shitty frivolous opinion to my face right then and there."
ORDER CONCERNING FREEMAN'S DEPOSITION
McMahon, J.:
My order requires no clarification. It is perfectly clear. Counsel for Ms. Freeman do not
get to set the rules.
Ms. Freeman will answer EVERY question that is put to her - whether or not the question
was asked previously.
If Ms. Freeman asserts attorney client privilege with respect to a question that was not
previously asked, you are to call my chambers immediately to obtain a ruling. If I have to rule on more than one frivolous attorney client privilege objection, there will be consequences, in the form of sanctions, adverse inferences, referrals to the court's Grievance
Committee with the possible revocation of pro hac vice admission to practice or admission to the Bar of this Court, and the possibility of a civil contempt holding. Please understand — this is not an idle threat. I am tired of this. I do not believe that Ms. Freeman's counsel is acting in good faith and I will not stand for being jerked around - and I am indeed being jerked around — in this
manner by any lawyer who practices before me.

Most of us would absolutely do #1. Not counsel for Freeman. Counsel for Freeman is like "okay I know you said we can only say no if it implicates attorney-client privilege, but what if it does? what then? because you also said to answer ALL questions."
1. Whether the Order preserves the privilege ground for questions not previously asked The Order states that "directions not to answer are limited to questions that call for privileged information," consistent with Rule 30(c)(2), and then rules that none of the questions Ms. Freeman declined to answer on September 14 implicated the attorney-client privilege. The Order goes on to provide that "all other objections" may be noted but the witness "MUST answer," and that "[a]ny direction not to answer that goes
beyond this ruling" will result in an adverse presumption and personal sanctions against the directing attorney. We read these provisions together to mean that (a) the previously refused questions must be answered, and (b) at the continued session, an instruction not to answer remains available only where a new question calls
for privileged information, as Rule 30(c)(2) permits. But one could plausibly read the phrase "the deposition will go on for as long as it takes" and the direction to answer "ALL questions" as proscriptively foreclosing any instruction not to answer any question on any ground. Because the Order attaches contempt exposure to a
misreading, I respectfully ask the Court to confirm which reading is intended.

Both sets of lawyers say that for attorney-client privilege reasons, they cannot discuss their work product. But both of them say they believed the claim of copyright to be justified because of the access that the agent had, in addition to other material reviewed.
While I am not going to get into a discussion of my work product in this case, I can assure the Court that I and my firm pursued this case believing there was a strong claim of access and copying that went beyond unprotectable idea into protectable expression, and at no
point did we (or would we) knowingly advance any claims that were lacking in legal or
factual support. Indeed, as experienced copyright practitioners who understand the law,I cannot get into the details of my due diligence prior to filing the complaint
because it would require me to reveal attorney work product and attorney-client privileged information. In general, I read and reviewed voluminous written material, gathered the facts and conducted legal research over a period of over four months. To the
best of my knowledge, information and belief, formed after conducting the due diligence,
that I believed was reasonable under the circumstances, prior to filing the complaint I
believed that Freeman's copyright infringement claims were warranted by existing law,
they were not being brought for an improper purpose, such as to harass, cause
unnecessary delay, or needlessly increase the cost of litigation, the factual contentions had evidentiary support, and that Freeman had valid copyright infringement claims well
supported by both the law and the facts. I filed the complaint because I believed that she

And then she says: This shit was so rank that I'm gonna demand that the attorney who pulled this show cause why I shouldn't make him personally pay for the extra cost to re-depose Lynne Freeman.
Counsel for Ms. Freeman who attended the last session of her deposition must show
cause, within five business days, why he should not personally bear the cost of ( 1) the court
reporter's attendance at the deposition and the cost of the resulting transcript, and (2) the cost for
the attendance of two (2) attorneys for Defendants at said deposition, including the cost of travel,
if any.

AND IF YOU FUCK AROUND ONE MORE FUCKING TIME, LET ME TELL YOU PRECISELY HOW YOU ARE GOING TO FIND OUT. 1) I'll assume that the answer is the worst possible one 2) The attorney is gonna be sanctioned and possibly held in contempt
Any direction not to answer that goes beyond this ruling will have the
following consequences: (1) the Court will presume that the answer is favorable to the
Defendants' position that Ms. Freeman should be held liable for substantial attorneys' fees; and
(2) the directing attorney will be personally subject to sanctions and to the possibility of beingheld in contempt. The deposition must take place within the next ten days, at the location of
Defendants' choosing.

Anyway, McMahon ruled on the motion to compel. She's like "YOU HAD BETTER ANSWER THESE QUESTIONS, and if you don't like it, you object on the record and note your objection in your brief and I'll rule on it then, WHICH IS HOW THIS SHIT WORKS, and you know that! STOP FUCKING AROUND!"
Ms. Freeman must appear for a deposition at which she will answer ALL questions put to
her. As per the Federal Rules (see Rule 30(c)(2)), directions not to answer are limited to
questions that call for privileged information. We have reviewed the transcript of the previous
session of the deposition and none of the questions implicates attorney client privilege, so
Freeman may not interpose that objection to any of the questions that she refused to answer at
the deposition. For avoidance of doubt, the Court has not interposed any limitation on
questioning, and the deposition will go on for as long as it takes and is not limited to one day and
seven hours as per Rule 30(d)(3). All other objections, including to the form of questions, may be
placed on the record but the witness MUST answer the question notwithstanding the objection
and no attorney may direct otherwise; the objection will be ruled on if and when the evidence is
presented to the Court.
