I'm also curious, if not a control failure, were they FA and then got FO? "AI breaks out of sandbox" seems like it could be a cover as well, but I also have trouble trusting their word.

No I suspect that they didn't have proper monitoring of their training on openai & api monitoring on hf side to know they effed up until hf called them saying something ain't right. And it probly took both their legal teams weeks to allow each other to say something without getting into a courtroom.
