If Biden really opposes Trump's mass deportation plans one thing he could do is pardon everyone who entered the country illegally more than 20 years ago or under the age of 12 or who is awaiting an asylum decision.

However, for the seven other examples tested, most voters think immigrants should not be deported. Only 31% of voters think a person with a doctoral degree from a U.S. university who overstayed their visa should be deported. Additionally, less than 1 in 4 voters think the following people should be deported: an undocumented community volunteer who has lived in the U.S. for 10 years and has no criminal record (24%), an undocumented person who has lived in the U.S. for 15 years and has U.S.-born children (24%), and an undocumented person who has lived in the U.S. for more than 10 years and owns a small business employing American workers (24%).

Even smaller percentages of voters think a person residing in the U.S. under Temporary Protected Status (TPS) from an ongoing conflict (21%), a person who has been awaiting a decision on their asylum application for three years (20%), and a person brought to the U.S. without legal status as a child 20 years ago (19%) should be deported.

“Unlawful presence” is a civil offense, not a crime. The pardon power only covers criminal acts.

I don't think this first one works. A pardon does not let you off for continuing to break a federal law after the pardon is granted. So if someone is residing in the country, but does not have legal status, they'd still get the boot.

Another cool thing Biden could do is pardon anyone who "may have" participated in stealing the 2020 election and also anyone, like Fauci, Schiff and Vindman, who Trump and his allies have specifically named as a target. Sorry, Kash!

Unfortunately that doesn't protect them from deportation because ICE can still deport anyone they like who doesn't have some kind of residency status. They don't have to be criminals for ICE to deport them.

In my opinion, everyone needs to start excepting the idea that what we currently expect as the rule of law is going to continue to be seriously subverted. They have positioned all the pieces to throw out the rules. The billionaires aren’t trying to fix the government. They just want it broken.
