NHS staff in England suspected of looking at patient records without a valid reason will be immediately suspended as part of a "zero-tolerance crackdown" on snooping.

Those under suspicion will also be locked out of NHS computer systems, preventing any further viewing of confidential records, including from home.

NHS England chief executive Sir Jim Mackey has written to every trust, ordering the measures to be introduced immediately to strengthen protection against data breaches.

Emails from August 2023 obtained by the FT through a freedom of information request show Byrne delayed publishing the statement about the FDP after Ming Tang, NHS England's then chief data officer, warned it would "create significant problems" for her.

Tang raised concerns about what she argued was "inflammatory" language and a lack of balance in the statement after Byrne shared an advance copy.

The health care board for one part of England, Greater Manchester, has repeatedly declined to adopt Palantir's FDP, choosing to stick with a home-spun platform developed over the best part of a decade. The board claims it doesn’t need Palantir, that its own platform is functionally superior and more trusted by the public. "[Even] a technically strong platform will struggle to realize value if clinicians, data controllers, patients or the public do not trust it," Matt Hennessey, chief data and analytics officer at NHS Greater Manchester, tells WIRED. "If we were to fully adopt the FDP … it would be a retrograde step."

That claim—disputed by Palantir and other FDP advocates—has fed into a national debate over whether the government should seize an opportunity next February to terminate the NHS contract early, instead of allowing it to run until 2031.

Public trust and confidence

There has been much interest in this statement. The intensity of interest and strength of public feeling on this issue appear to reflect not only how deeply many people care about the use of their data, and its confidentiality, but also continuing concern amongst some about Palantir's role in the NHS. This topic has always been to some extent political. As such, people have a range of views. And public, professional and media scrutiny has only increased over time. This means that accuracy and transparency must remain central priorities for the NHS FDP programme. This incident has shown how quickly confidence erodes if the "no surprises" principle (Caldicott Principle 8) is not upheld when it comes to who can access people's data, and why.
