All U.S. courts have judicial review, (aka the supreme power to tell other parts of the government they are behaving unlawfully) right? Actually, no. Some tribal courts don't. Read my latest in UChicago Law Review for more.

Wohoo! And it’s about time… The Oneida Nation endowed a chair for an Indian Law scholar at HLS and they’ve been trying to fill it for DECADES. It took the incredible badass that is Tanner to break down that door finally. So proud and excited. This is a win for Indian Country and for the field!

I have a new short article out. My take on the last 50 years of Federal Indian Policy and the strange crossroads we are at. TLDR: Paternalism was bad. Reversing it--aka the fed. gov. incrementally giving up it's power--is hard. And it's not something Trump likes doing.

Been out of the SCOTUS opinion analysis for a min (baby). But this Gorsuch Dissent (joined by Thomas 😮) from cert. denial in Veneno v. US, which challenged the Major Crimes Act (a fed. law that allows feds. to prosecute crimes on Indian Reservations), is worth discussing/explaining for a sec. 🧵 1/8

🚨 Super exciting news…the new edition of the Bluebook has a brand new rule… Rule 22 on how to cite materials from Tribal Nations!!! A long overdue and welcome development. Tribal Law scholars, we have a lot to be proud of today. Tribal Law and Tribal Nations are a little less invisible today.🫶🏽✊🏽
